7. When an older sibling engages in a sexual act with a sibling, adoptive sibling,<br />

stepsibling or foster sibling who under the age <strong>of</strong> fourteen (14) years, the older sibling<br />

shall be punished as provided for in paragraph 4 <strong>of</strong> this Article.<br />

CHAPTER XXI<br />

CRIMINAL OFFENSES AGAINST MARRIAGE AND FAMILY<br />

Article 244<br />

Bigamy<br />

1. Whoever, being already married, enters into another marriage shall be punished by<br />

imprisonment <strong>of</strong> up to one (1) year.<br />

2. Whoever enters into a marriage with a person whom he or she knows to be already<br />

married shall be punished as provided for in paragraph 1 <strong>of</strong> this Article.<br />

3. When, subsequent to the commission <strong>of</strong> the <strong>of</strong>fense provided for in this Article, the<br />

previous marriage has invalidated, annulled or terminated, the prosecution for the <strong>of</strong>fense<br />

shall not be initiated and if it has been already initiated, it shall be terminated.<br />

Article 245<br />

Enabling unlawful marriages to take effect<br />

An authorized <strong>of</strong>ficial person before whom a marriage takes effect who, in abusing his or<br />

her position or authorizations, permits a marriage to take effect despite having knowledge<br />

<strong>of</strong> legal impediments which prohibit the marriage shall be punished by imprisonment <strong>of</strong><br />

three (3) months to three (3) years.<br />

Article 246<br />

Forced marriage<br />

1. Whoever compels another person to enter into a marriage or enters into a marriage<br />

with a person whom he or she knows to be compelled into the marriage shall be punished<br />

by imprisonment one (1) to eight (8) years.<br />

2. When the criminal <strong>of</strong>fence from paragraph 1 <strong>of</strong> this Article is committed against a<br />

child, the perpetrator shall be punished by imprisonment <strong>of</strong> two (2) to ten (10) years.<br />

3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed by a parent,<br />

an adoptive parent, guardian or another person exercising parental authority over a person<br />
