set forth in Article 422, 428 429 <strong>of</strong> this <strong>Code</strong>;<br />

2.34. misappropriation in Office Fraud in Office as set forth in Articles 425 and<br />

426 <strong>of</strong> this <strong>Code</strong>;<br />

2.35. fraud Related to Receiving Funds from European Community as set forth in<br />

Article 337 <strong>of</strong> this <strong>Code</strong>;<br />

2.36. conflict <strong>of</strong> Interests as set forth in Article 424 <strong>of</strong> this <strong>Code</strong>.<br />

Article 442<br />

Transitional provisions for the jurisdiction <strong>of</strong> Eulex judges and prosecutors in<br />

criminal proceedings<br />

1. With the entry into force <strong>of</strong> this <strong>Criminal</strong> <strong>Code</strong> the EULEX judges and prosecutors<br />

assigned to criminal proceedings will have jurisdiction and competence over any case<br />

that can be investigated or prosecuted by the Special Prosecution Office <strong>of</strong> the Republic<br />

<strong>of</strong> <strong>Kosovo</strong>.<br />

2. Before the commencement <strong>of</strong> the relevant stage <strong>of</strong> the proceeding, upon petition <strong>of</strong> the<br />

EULEX Prosecutor assigned to the case or working in the mixed team identified in<br />

Articles 9 and 10 <strong>of</strong> the Law on the Jurisdiction, Case Selection and Case Allocation <strong>of</strong><br />

EULEX Judges and Prosecutors in <strong>Kosovo</strong>, or upon petition <strong>of</strong> any <strong>of</strong> the parties to the<br />

proceeding, or upon a written request <strong>of</strong> the President <strong>of</strong> the competent court or <strong>of</strong> the<br />

General Session or <strong>of</strong> the Supreme Court <strong>of</strong> <strong>Kosovo</strong> where the provisions related to the<br />

disqualification <strong>of</strong> a judge or lay judge foreseen by the <strong>Criminal</strong> Procedure <strong>Code</strong> <strong>of</strong><br />

<strong>Kosovo</strong> are not applicable, the President <strong>of</strong> the Assembly <strong>of</strong> EULEX Judges will have the<br />
