perpetrator; except that torture shall not include pain or suffering arising only<br />

from, inherent in or incidental to, lawful sanctions;<br />

2.6. Forced pregnancy - the unlawful confinement <strong>of</strong> a woman forcibly made<br />

pregnant, with the intent <strong>of</strong> affecting the ethnic composition <strong>of</strong> any population or<br />

carrying out other grave violations <strong>of</strong> international law;<br />

2.7. Persecution - the intentional and severe deprivation <strong>of</strong> fundamental rights<br />

contrary to international law by reason <strong>of</strong> the identity <strong>of</strong> the group or collectivity;<br />

2.8. Crime <strong>of</strong> apartheid - inhumane acts <strong>of</strong> a character similar to those provided<br />

for in paragraph 1 <strong>of</strong> this Article, committed in the context <strong>of</strong> an institutionalized<br />

regime <strong>of</strong> systematic oppression and domination by one racial group over any<br />

other racial group or groups and committed with the intention <strong>of</strong> maintaining that<br />

regime;<br />

2.9. Enforced disappearance <strong>of</strong> persons - the arrest, detention or abduction <strong>of</strong><br />

persons by, or with the authorization, support or acquiescence <strong>of</strong>, a state or a<br />

political organization, followed by a refusal to acknowledge that deprivation <strong>of</strong><br />

freedom or to give information on the fate or whereabouts <strong>of</strong> those persons, with<br />

the intention <strong>of</strong> removing them from the protection <strong>of</strong> the law for a prolonged<br />

period <strong>of</strong> time;<br />

2.10. Gender - refers to the two (2) sexes, male and female, within the context <strong>of</strong><br />

society.<br />

Article 150<br />

War crimes in grave violation <strong>of</strong> the Geneva conventions<br />

1. Whoever commits a grave violation <strong>of</strong> the Geneva Conventions <strong>of</strong> 12 August 1949<br />

shall be punished by:<br />

1.1. imprisonment <strong>of</strong> not less than ten (10) years or by life long imprisonment, in<br />

the case <strong>of</strong> the <strong>of</strong>fense provided for in sub-paragraphs 2.4, 2.5, 2.6, 2.7 or 2.8 <strong>of</strong><br />

paragraph 2 <strong>of</strong> this Article; or<br />

1.2. imprisonment <strong>of</strong> not less than fifteen (15) years or by life long imprisonment,<br />

in the case <strong>of</strong> the <strong>of</strong>fense provided for in sub-paragraphs 2.1, 2.2, or 2.3 <strong>of</strong><br />

paragraph 2 <strong>of</strong> this Article.<br />

2. A grave violation <strong>of</strong> the Geneva Conventions <strong>of</strong> 12 August 1949 means one or more<br />

<strong>of</strong> the following acts committed during war time or armed conflict against persons or<br />

property protected under the provisions <strong>of</strong> the relevant Geneva Convention:<br />

2.1. willful killing;<br />
