Article 116<br />

Applicability <strong>of</strong> criminal laws <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong> to foreign person<br />

committing criminal <strong>of</strong>fenses outside the territory <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong><br />

1. The criminal laws <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong> apply to any person who is a foreign<br />

person if:<br />

1.1. such person has committed a criminal <strong>of</strong>fense outside the territory <strong>of</strong> the<br />

Republic <strong>of</strong> <strong>Kosovo</strong> against a national <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong> even when such<br />

a criminal <strong>of</strong>fense is not referred to in Article 115 <strong>of</strong> this <strong>Code</strong>;<br />

1.2. this act is also punishable at the place <strong>of</strong> its commission; and<br />

1.3. the perpetrator is found on the territory <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong> or has<br />

been transferred to the Republic <strong>of</strong> <strong>Kosovo</strong>.<br />

Article 117<br />

Special prerequisites for prosecution <strong>of</strong> criminal <strong>of</strong>fenses committed outside the<br />

territory <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong><br />

1. In the cases provided for in Article 114 <strong>of</strong> this <strong>Code</strong>, if criminal proceedings have<br />

commenced but have not been completed in another jurisdiction, criminal proceedings<br />

shall be initiated in the Republic <strong>of</strong> <strong>Kosovo</strong> only upon the authorization <strong>of</strong> the Chief State<br />

Prosecutor <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong>.<br />

2. In the cases provided for in Articles 115 and 116 <strong>of</strong> this <strong>Code</strong>, criminal proceedings<br />

shall not be initiated if:<br />

2.1. the perpetrator has completely served the punishment imposed in another<br />

jurisdiction;<br />

2.2. the perpetrator has been acquitted in another jurisdiction by a final court<br />

judgment or the punishment was waived or prescribed by statutory limitation; or<br />

2.3. criminal proceedings for that criminal <strong>of</strong>fense in another jurisdiction may<br />

only be initiated upon request <strong>of</strong> the injured party and such request has not been<br />

presented.<br />

3. <strong>Criminal</strong> proceedings pursuant to Article 118 <strong>of</strong> this <strong>Code</strong> may be initiated in the<br />

Republic <strong>of</strong> <strong>Kosovo</strong> only upon the authorization <strong>of</strong> the Chief State Prosecutor <strong>of</strong> the<br />

Republic <strong>of</strong> <strong>Kosovo</strong>.<br />

4. In the cases provided for in Article 114 <strong>of</strong> this <strong>Code</strong> the criminal prosecution <strong>of</strong> a<br />

foreign person may be transferred to a foreign jurisdiction on the condition <strong>of</strong> reciprocity.<br />
