damage <strong>of</strong> large quantities <strong>of</strong> products, goods or materials; or, causes interruptions in the<br />
process <strong>of</strong> production and the cost <strong>of</strong> the damage or destruction exceeds fifty thousand<br />
(50,000) EUR shall be punished by imprisonment <strong>of</strong> not less than three (3) years.<br />
Article 131<br />
Espionage<br />
1. Whoever communicates, hands over a State secret or makes a State secret accessible to<br />
a foreign country, foreign organization or to the person serving them shall be punished<br />
from imprisonment <strong>of</strong> five (5) to twelve (12) years.<br />
2. Whoever creates an intelligence service in the Republic <strong>of</strong> <strong>Kosovo</strong> for a foreign State,<br />
country or organization or directs such service shall be punished by imprisonment <strong>of</strong> not<br />
less than ten (10) years.<br />
3. Whoever enters a foreign intelligence service, collects data for them or in any other<br />
way supports the work <strong>of</strong> such service shall be punished by imprisonment at least five (5)<br />
years.<br />
4. Whoever collects classified data or documents with the aim <strong>of</strong> communicating and<br />
handing them over to a foreign State, country, foreign organization or to the person<br />
serving them, shall be punished by imprisonment <strong>of</strong> three (3) to ten (10) years.<br />
5. If the commission <strong>of</strong> the criminal <strong>of</strong>fense in paragraph 1, 2, 3. or 4 <strong>of</strong> this Article<br />
caused severe consequences for the security, economic or military power <strong>of</strong> the Republic<br />
<strong>of</strong> <strong>Kosovo</strong>, the perpetrator shall punished by imprisonment <strong>of</strong> at least ten (10) years.<br />
6. If the criminal <strong>of</strong>fense listed in paragraph 1, 2, 3 or 4 <strong>of</strong> this Article is committed<br />
during the time <strong>of</strong> war, imminent danger <strong>of</strong> war, armed conflict or the revealing <strong>of</strong> a state<br />
secret concerns the security <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong>, the perpetrator shall be punished<br />
by imprisonment <strong>of</strong> not less than ten (10) years.<br />
7. For the purposes <strong>of</strong> this Article, “State secret” means the military, economic, or<br />
<strong>of</strong>ficial information, data or documents that by law or other provisions or decisions <strong>of</strong> a<br />
competent body and issued pursuant to the law that are pronounced as classified<br />
information.<br />
Article 132<br />
Disclosure <strong>of</strong> classified information and failure to protect classified information<br />
Whoever discloses or fails to protect classified information shall be punished as set forth<br />
in the Law on the Classification <strong>of</strong> Information and Security Clearances.<br />
