Article 175<br />
Hostage-taking<br />
1. Whoever takes hostage and threatens to kill a person, to injure or to continue to keep<br />
such person with the intent to compel a State or international organization, to do or<br />
abstain from doing an act as an explicit or implicit condition for the release <strong>of</strong> the<br />
hostage, shall be punished by imprisonment <strong>of</strong> not less than three (3) years.<br />
2. Whoever intentionally deprives the hostage <strong>of</strong> his or her life in committing an <strong>of</strong>fense<br />
provided for in paragraph 1 <strong>of</strong> this Article shall be punished by not less than ten (10)<br />
years or <strong>of</strong> life long imprisonment.<br />
3. When the <strong>of</strong>fense in paragraph 1 <strong>of</strong> this Article results in the death <strong>of</strong> the hostage, the<br />
perpetrator shall be punished by imprisonment <strong>of</strong> not less than ten (10) years.<br />
Article 176<br />
Unlawful appropriation, use, transfer and disposal <strong>of</strong> nuclear material<br />
1. Whoever, without authorization, receives, possesses, uses, transfers, alters, disposes or<br />
disperses nuclear material and causes or is likely to cause death or serious injury to any<br />
person or substantial damage to property shall be punished by imprisonment <strong>of</strong> not less<br />
than five (5) years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1. <strong>of</strong> this Article results in the death <strong>of</strong> one<br />
or more persons or substantial material damage, the perpetrator shall be punished by<br />
imprisonment <strong>of</strong> not less than ten (10) years or by life long imprisonment.<br />
3. Whoever commits the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article by<br />
negligence shall be punished by imprisonment <strong>of</strong> up to seven (7) years, in the case <strong>of</strong> the<br />
<strong>of</strong>fense provided for in paragraph 1 and by imprisonment <strong>of</strong> not less than three (3) years<br />
in the case <strong>of</strong> the <strong>of</strong>fense provided for in paragraph 2 <strong>of</strong> this Article.<br />
4. Whoever commits theft, robbery or misappropriation <strong>of</strong> nuclear material or makes a<br />
demand for nuclear material by the use <strong>of</strong> force, serious threat or by any other form <strong>of</strong><br />
intimidation shall be punished by imprisonment <strong>of</strong> not less than five (5) years.<br />
Article 177<br />
Threats to use or commit theft or robbery <strong>of</strong> nuclear material<br />
1. Whoever threatens to use nuclear material to cause death or serious injury to any<br />
person or substantial property damage shall be punished by imprisonment <strong>of</strong> one (1) to<br />
eight (8) years.<br />
