Article 429<br />
Giving bribes<br />
1. Whoever promises, <strong>of</strong>fers or gives, directly or indirectly, any undue gift or advantage<br />
to an <strong>of</strong>ficial person so that the <strong>of</strong>ficial person acts or refrains from acting in accordance<br />
with his or her <strong>of</strong>ficial duties, shall be punished by a fine or imprisonment <strong>of</strong> up to three<br />
(3) years.<br />
2. Whoever promises, <strong>of</strong>fers or gives, directly or indirectly, any undue gift or advantage<br />
to an <strong>of</strong>ficial person so that the <strong>of</strong>ficial person acts or refrains from acting, in violation <strong>of</strong><br />
his or her <strong>of</strong>ficial duties, shall be punished by a fine and imprisonment <strong>of</strong> three (3)<br />
months to three (3) years.<br />
3. When the <strong>of</strong>fense under paragraph 1 <strong>of</strong> this Article results in a benefit exceeding<br />
fifteen thousand (15,000) EUR, the perpetrator shall be punished by fine and<br />
imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
4. When the perpetrator <strong>of</strong> the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article<br />
gave the bribe at the request <strong>of</strong> an <strong>of</strong>ficial person or responsible person and reported the<br />
<strong>of</strong>fense before it was discovered or before knowing that the <strong>of</strong>fense was discovered, the<br />
court may waive the punishment.<br />
Article 430<br />
Giving bribes to foreign public <strong>of</strong>ficial<br />
1. Whoever promises, <strong>of</strong>fers or gives, directly or indirectly, any undue gift or advantage<br />
to a foreign public <strong>of</strong>ficial, so that the foreign public <strong>of</strong>ficial or another person, acts or<br />
refrains from acting in the exercise <strong>of</strong> his or her <strong>of</strong>ficial duties, shall be punished by a<br />
fine and imprisonment <strong>of</strong> up to five (5) years.<br />
2. Whoever promises, <strong>of</strong>fers or gives, directly or indirectly, any undue gift or advantage<br />
to a foreign public <strong>of</strong>ficial, so that the foreign public <strong>of</strong>ficial or another person, acts or<br />
refrains from acting in violation <strong>of</strong> his or her <strong>of</strong>ficial duties, shall be punished by a fine<br />
and imprisonment <strong>of</strong> one (1) to five (5) years.<br />
3. When the <strong>of</strong>fense under paragraph 1 <strong>of</strong> this Article results in a benefit exceeding<br />
fifteen thousand (15,000) EUR, the perpetrator shall be punished by fine and<br />
imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
4. The gift or benefit <strong>of</strong>fered or received in violation <strong>of</strong> this Article shall be confiscated.<br />
