Article 408<br />

Unlawful facilitation <strong>of</strong> the exercise <strong>of</strong> a pr<strong>of</strong>ession, activity or duty<br />

Whoever enables another person to exercise a pr<strong>of</strong>ession, activity or duty, even though he<br />

or she knows that a final judgment imposing an accessory punishment has prohibited the<br />

person from exercising such pr<strong>of</strong>ession, activity or duty shall be punished by a fine or<br />

imprisonment <strong>of</strong> three (3) months to three (3) years.<br />

CHAPTER XXXIII<br />

CRIMINAL OFFENSES AGAINST PUBLIC ORDER<br />

Article 409<br />

Obstructing <strong>of</strong>ficial persons in performing <strong>of</strong>ficial duties<br />

1. Whoever, by force or serious threat, obstructs or attempts to obstruct an <strong>of</strong>ficial person<br />

in performing <strong>of</strong>ficial duties or, using the same means, compels him or her to perform<br />

<strong>of</strong>ficial duties shall be punished by imprisonment <strong>of</strong> three (3) months to three (3) years.<br />

2. Whoever participates in a group <strong>of</strong> persons which by common action obstructs or<br />

attempts to obstruct an <strong>of</strong>ficial person in performing <strong>of</strong>ficial duties or, using the same<br />

means, compels him or her to perform <strong>of</strong>ficial duties shall be punished by a fine or by<br />

imprisonment <strong>of</strong> up to three (3) years.<br />

3. The leader or organizer <strong>of</strong> the group which commits the <strong>of</strong>fense provided for in<br />

paragraph 2 <strong>of</strong> this Article shall be punished by imprisonment <strong>of</strong> one (1) to five (5) years.<br />

4. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article involves a threat to<br />

use a weapon or dangerous instrument or results in bodily injury, the perpetrator shall be<br />

punished by imprisonment <strong>of</strong> six (6) months to five (5) years.<br />

5. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article is committed against<br />

a judge, a prosecutor, an <strong>of</strong>ficial <strong>of</strong> a court, prosecution <strong>of</strong>ficer or a person authorized by<br />

the court and prosecution <strong>of</strong>fice, a police <strong>of</strong>ficer, a military <strong>of</strong>ficer, a customs <strong>of</strong>ficer or a<br />

correctional <strong>of</strong>ficer during the exercise <strong>of</strong> their <strong>of</strong>ficial functions the perpetrator shall be<br />

punished by imprisonment <strong>of</strong> one (1) to five (5) years.<br />

6. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article results in grievous<br />

bodily injury, the perpetrator shall be punished by imprisonment <strong>of</strong> at least five (5) years.<br />
