contribute to a smoother removal process. SIS registration of rejected asylum seekers can also<br />

be useful in identifying rejectees subsequently applying <strong>for</strong> asylum in any other European state.<br />

1.4 STATISTICS ON INVOLUNTARY RETURN<br />

The Ministry of Interior statistics do not distinguish between asylum seekers and other irregular<br />

migrants in France. In 1997, 28 per cent of expulsion orders (all categories) were implemented,<br />

whereas this percentage fell to 20 per cent in 1998. As a result, a Ministry of Interior Circular<br />

dated 11 October 1999 requested Prefectures to increase random identity checks and to improve<br />

the implementation of expulsion/deportation orders.<br />

Yet in 2002, fewer than 20 per cent of expulsion orders were implemented.<br />

2. ASSISTED VOLUNTARY RETURN<br />

2.1 POLICY AND LEGISLATIVE INSTRUMENTS AND PROVISIONS<br />

Although no specific assisted voluntary return programmes exist in France, a legal basis <strong>for</strong><br />

assisted returns can be found in the 1945 Ordinance on the Conditions <strong>for</strong> Entry and Residence<br />

of Foreign Nationals in France, as amended by subsequent laws. This legislation provides <strong>for</strong>eign<br />

nationals with four different types of voluntary return mechanisms, although they are not<br />

used much in practice. These include the following:<br />

Public Assistance <strong>for</strong> Reintegration (Aide publique à la reinsertion – APR)<br />

This procedure, implemented since 1984, allows <strong>for</strong>eigners staying in France on a regular basis<br />

(with a valid residence permit) to return to their home country to carry out a project with a<br />

reintegration purpose.<br />

Invitation to Leave the National Territory (Invitation à quitter le territoire)<br />

This concerns third-country nationals, who must leave the country due to rejection of a residence<br />

permit request or extension, or the rejection of an asylum application. The Prefect delivers<br />

the document and in<strong>for</strong>ms the third-country national that he/she is entitled to assistance from the
