NORWAY<br />

Lack of the necessary travel documents (e.g. valid passport, visa);<br />

A previous expulsion from Norway or another Nordic country and consequently being subject<br />

to prohibition of entry;<br />

Lack of the required work, residence or settlement permit;<br />

Failure to provide evidence of the necessary means to support his/her stay in Norway and pay<br />

<strong>for</strong> his/her return journey;<br />

An earlier sentence, as prescribed under Article 29 of the Immigration Act (see below), or<br />

grounds <strong>for</strong> believing that the individual may commit an offence punishable with imprisonment<br />

of a term exceeding three months;<br />

Probability of the person entering another Nordic country from Norway, where he/she is likely<br />

to be rejected <strong>for</strong> entry because of a lack of the required travel documentation or <strong>for</strong> any other<br />

grounds;<br />

Where national security or compelling social considerations make it necessary. 4<br />

Exceptions are made where the individual concerned lodges a claim <strong>for</strong> asylum, in which case<br />

the application will be referred to the Directorate <strong>for</strong> Immigration (UDI) <strong>for</strong> consideration.<br />

According to Article 17 of the Immigration Act, asylum seekers may be refused entry in the<br />

following circumstances:<br />

There are reasonable grounds <strong>for</strong> regarding him/her as a danger to national security;<br />

He/she constitutes a danger to the community following conviction <strong>for</strong> a particularly serious<br />

crime;<br />

He/she is in one of the situations mentioned in Article 1(f) of the Geneva Convention, relating<br />

to war crimes, crimes against humanity and acts contrary to the principles of the United<br />

Nations;<br />

He/she has already been granted asylum in another country;<br />

He/she has travelled to Norway on his/her own initiative after being granted protection in<br />

another country, or after having stayed in a state or area where he/she was not persecuted and<br />

had no reason to fear refoulement;<br />

Another Nordic state is obliged to accept him/her in accordance with the Nordic Passport<br />

Control Convention;<br />

Asylum must be denied on the grounds of compelling social considerations.<br />

Grounds <strong>for</strong> Expulsion<br />

Article 29 of the Immigration Act stipulates that a <strong>for</strong>eign national may be expelled from the<br />

territory if:<br />

He/she has grossly or repeatedly contravened one or more provisions of the Immigration Act<br />

or has evaded the implementation of an order to leave the country;<br />

He/she has served a sentence, or has been sentenced <strong>for</strong> an offence abroad, which according<br />

to Norwegian law is punishable with imprisonment <strong>for</strong> a term exceeding three months, within<br />

the last five years;<br />

He/she has been sentenced, or placed under preventive supervision, in Norway, <strong>for</strong> an offence
