Aliens Police is crucial in ensuring concerted ef<strong>for</strong>ts to deal with migration challenges.<br />

2. ASSISTED VOLUNTARY RETURN<br />

2.1 POLICY AND LEGISLATIVE INSTRUMENTS AND PROVISIONS<br />

The Republic of Slovakia has a clear policy supporting the voluntary return of migrants to their<br />

countries of origin.<br />

The Act on Asylum and Amendment of Some Acts (as of June 20, 2002) has a section on<br />

“Cooperation with the <strong>International</strong> <strong>Organization</strong> <strong>for</strong> <strong>Migration</strong>” (Section 44), which identifies<br />

the Ministry of Interior <strong>for</strong> cooperation with <strong>IOM</strong> in carrying out voluntary returns. “The Ministry<br />

shall cooperate with the <strong>International</strong> <strong>Organization</strong> <strong>for</strong> <strong>Migration</strong> in arranging the movement<br />

of aliens who want to return voluntarily to their country of origin or to a third country.”<br />

Be<strong>for</strong>e the law was adopted, in August 1998, the Ministry of Interior and <strong>IOM</strong> had an existing<br />

cooperation agreement to provide assistance to unsuccessful asylum seekers and irregular<br />

migrants returning to their countries of origin. The above-mentioned Act on Asylum and Amendment<br />

of Some Acts further provides the legal basis <strong>for</strong> voluntary return activities in the country.<br />

2.2 ADMINISTRATIVE AND PROCEDURAL ARRANGEMENTS<br />

Institutions Responsible <strong>for</strong> Voluntary <strong>Return</strong><br />

The Slovak authorities and the <strong>IOM</strong> office in the country have worked together to assist irregular<br />

migrants and unsuccessful asylum seekers in returning to their countries of origin. Such returns<br />

are fully based on the wishes of returnees.
