<strong>Return</strong> <strong>Migration</strong>: Policies and Practices<br />

Asylum seekers who have renounced their pursuit of refugee status;<br />

Other <strong>for</strong>eigners who were obliged by the competent alien police authorities to leave the<br />

territory of the country as a consequence of violating the law on <strong>for</strong>eigners’ entry and stay in<br />

Hungary, or against whom the conditions of ordering such obligation exist.<br />

In implementing voluntary return programmes, the government and <strong>IOM</strong> respect the provisions<br />

of relevant international instruments and Hungarian law and regulations in regard to the collection,<br />

processing and use of personal data. Disclosure of data to third parties can only be made<br />

with the consent of the person concerned.<br />

Joint Consultative Commission<br />

To facilitate implementation of the return programmes based on the MOU, relevant Hungarian<br />

authorities and the <strong>IOM</strong> field office in Hungary <strong>for</strong>med a Joint Consultative Commission. The<br />

Commission comprises authorities from the Hungarian Ministry of Interior, Office of Refugees<br />

and <strong>Migration</strong> Affairs, Aliens Police, Border Guard and a representative of <strong>IOM</strong>. <strong>IOM</strong> <strong>for</strong>ms the<br />

secretariat of the Commission; and the Commission meets when necessary and with the following<br />

tasks:<br />

Monitor and analyse experience and new developments in the field of return;<br />

Advise on feasibility and merits of new initiatives;<br />

Regularly review the implementation of ongoing activities and programmes;<br />

Examine cooperation modalities with governmental and non-governmental organizations dealing<br />

with return of migrants.<br />

Practical Procedures<br />

Within the voluntary return programme managed by <strong>IOM</strong> in cooperation with Hungarian<br />

authorities, the practical procedures <strong>for</strong> implementing voluntary return are defined in the MOUs.<br />

The relevant authorities of the Ministry of Interior undertake to (1) in<strong>for</strong>m potential beneficiaries<br />

of their legal status and the possibilities available to them under the programme; (2) in<strong>for</strong>m<br />

the <strong>IOM</strong> office in Hungary of the person who may benefit from the programme; (3) give the<br />

<strong>IOM</strong> office in Hungary a comprehensive description of the current legal status of the person.<br />

The Ministry of Interior will take responsibility <strong>for</strong> any coordination needed among governmental<br />

authorities.<br />

<strong>IOM</strong>’s responsibilities are multi-faceted. <strong>IOM</strong> is responsible <strong>for</strong> (1) providing potential beneficiaries<br />

with in<strong>for</strong>mation on programme options as soon as possible; (2) counseling potential<br />

returnees on practical issues, in<strong>for</strong>ming them of the conditions in the countries of origin; (3) if<br />

voluntary return is decided, arranging valid travel documents <strong>for</strong> travel; (4) providing transportation<br />

assistance and other related service if needed; (5) as required, providing assistance <strong>for</strong><br />

initial reintegration of returnees into their communities.<br />

In implementing voluntary returns, <strong>IOM</strong> widely distributes in<strong>for</strong>mation sheets, posters, flyers<br />

and brochures in different languages. The voluntary return application <strong>for</strong>ms are prepared in<br />

Hungarian, English, Chinese, Greek and Bengali. While it is not possible <strong>for</strong> each and every<br />
