NOTE: Ban the Box: Returning Citizens Public Employment Inclusion Act 2012<br />

prohibits DC municipal agencies from inquiring about an applicant’s criminal past at the<br />

initial stage of the application process. The law further requires city agencies to consider<br />

balancing factors when reviewing applications, i.e. evidence of rehabilitation, time passed<br />

since the offense, and the relevance of the offense to the position sought. If the criminal<br />

past is a hiring factor, the applicant may provide an explanation of their history and the<br />

employer must consider the rehabilitation of the applicant before making a final decision.<br />

For assistance with providing an explanation of criminal history to an employer contact<br />

the Community Reentry Program of the DC Public Defender Service (202) 824-2801.<br />

Currently 53 other jurisdictions including Baltimore, Chicago, Austin, and Boston have<br />

similar laws banning the box on employment applications.<br />

Target Stores: Target Stores were the first national chain to recognize “Ban the Box” on<br />

all their job applications.<br />
