she is booked into jail regardless of conviction.FSS 782 - HomicideFSS 784 - Assault; Battery; CulpableNegligenceFSS 794 - Sexual BatteryFSS 800 - Lewdness; Indecent Exposure(Felonies only)Beginning January 1 st , 2013, the following felonyarrests require a DNA sample at the time he orshe is booked into jail regardless of conviction.FSS 810 – Burglary and Trespass (felony)FSS 812 –CrimesTheft Robbery and RelatedPOLICY AND PROCEDURES:General ProceduresWhen an arrestee is brought into the facility on aqualifying arrest or when the RecordsClerk/Deputy receives court minutes showing aperson is convicted of any felony, attemptedfelony, or an enumerated misdemeanor, theRecords Clerk/Deputy will place a hold on theinmate's file in SmartCop stating DNA testing isneeded, and then they will:Check the FDLE database or use the RAPIDID device to determine if a DNA submissionis already on file.oIf the individual is listed on the web site,NO DNA test is needed.Beginning January 1 st , 2017, the following felonyarrests require a DNA sample at the time he orshe is booked into jail regardless of conviction.FSS 893 – Drug OffensesoIf the person is NOT listed on the website, then you must begin the process oftesting and complete thepaperwork/procedures that follow.Beginning January 1 st , 2019 ,ALL felony arrestsrequire a DNA sample at the time he or she isbooked into jail regardless of conviction.NOTE: Florida State Statue (FSS) 943.325states that those convicted in the past mustalso have DNA testing. To find out if aperson has submitted DNA, you will need tolook on the DNA web site.Approved Biological SpecimenAn approved biological specimen is:Epithelial cells collected from the cheek inthe oral cavity utilizing an FloridaDepartment of Law Enforcement (FDLE)approved swab collection kit, orA blood sample that shall consist of twospecimens of whole blood, each at least 7cc in volume. A blood sample will only bedone per court order and will be drawn onlyby medical personnel.NOTE: We do not take DNA frominmates sentenced to Florida StatePrison.In the case of a new conviction, theIntake/Release (I/R) Deputy will get thesubject from the housing unit to completethe testing process. If a new arrest, theDNA kit will be part of the booking process.The I/R Deputy will open the Swab Kit andcomplete the information first. Fill out thecard attached to the kit (front only), andplace a photocopy (front only) of the card inthe inmate's file.The I/R Deputy will then complete the swab,seal the envelope, and send it to theAdministration Lieutenant/designee.The Administration Lieutenant/designee willmail the DNA envelope to FDLE.The I/R Deputy will release the hold fromSmartCop after all the above is completed.Once the DNA kit is completed, check offthe DNA Obtained intel flag in SmartCop.BOC - 1:002 Date of Original: 9/15/99 2Previous Revision Date(s): 4/16/01, 9/24/01, 1/16/06, 1/10/08, 1/19/11, 12/30/11Dissemination Date: 5/10/13 Effective Date: 517/13
Common mistakes made during the DNAprocess are listed below and are to beavoided: illegible handwriting, incompleterolling of the fingerprint, not enoughspecimen on the FTA card, and failure tosign in all required locations.RAPID-ID DeviceWhen available, Intake Personnel will use theRapid-ID Device during the booking process tocheck all arrestees and registrant to see if theyhave already given DNA in the State of Florida.Sexual Predator/Sexual Offender RegistrationIF DNA was collected because this was a sexualpredator/offender that was required to registerDNA, ensure you complete a warrant check(QW) and the FDLE Sexual Predator/SexualOffender Registration Form. You do not need tofingerprint them if their fingerprints are already inthe FDLE database or they have been printed byMonroe County previously. Fax the requiredpaperwork to Marathon Special Operations andDispatch.Re-registrations are only done by theIdentification Division.Instructions on how to do this will be in theIntake area. You must use the index and middlefingers on either hand to check for identification.When you use those two fingers to check if thesubject has previously submitted DNA, theFlorida and National criminal history will comeup. You will be able to check to see if the subjectneeds DNA.NOTE: If the subject does not have a handthat has those two fingers, the rapid IDdevice cannot be used.Refusal to Provide DNA SampleAny person subject to the requirements toprovide a DNA sample who refuses to provide aDNA sample commits a misdemeanor of thesecond degree punishable as provided in FloridaState Statue 775.082 and 775.083. FloridaState Statue authorizes the use of reasonableforce to collect a sample. If an inmate/registrantrefuses to provide a sample, contact the shiftsupervisor.
