on nurses. The regulation laying down minimum training conditions for regulated professionssubject to automatic recognition was amended. However, recognition of professionalqualifications is still not differentiated from recognition of academic qualifications. Someregulated professions are still subject to reciprocal recognition. Nationality and languagerequirements remain.‘The right of establishment and freedom to provide services’ is one of the eight chapterscovered by the conclusions on Turkey adopted by the Council (General Affairs and ExternalRelations) on 11 December 2006 and endorsed by the European Council on 14/15 December2006. As long as restrictions remain in place on the free movement of goods carried byvessels and aircraft registered in Cyprus or whose last port of call was in Cyprus, Turkey willnot be in a position to implement fully the acquis relating to this chapter.ConclusionAlignment under this chapter is, overall, at an early stage. No progress can be reported in theareas of right of establishment, freedom to provide cross border services, and postal services.There has been very limited progress regarding mutual recognition of professionalqualifications.4.4. Chapter 4: Free movement of capitalThere has been no progress in capital movements and payments over the reporting period.Turkey has yet to make significant progress on alignment of its legislation with the acquis.The legislative framework regulating real-estate acquisition by foreigners remainsinconsistent with Article 63 of the Treaty on the Functioning of the European Union. Turkeystill needs to propose an action plan for gradual liberalisation of acquisition of real estate byforeigners in line with the acquis and to demonstrate that it is making progress towardsgradual liberalisation, which is a key element for the accession negotiations in this chapter.There has been no progress on removing remaining restrictions on foreign direct investmentsoriginating from the EU, a priority in this area. Sectoral restrictions remain in place, forexample on energy, transport, education and radio and TV broadcasting. A draft law raisingthe limit on foreign participation in the above-mentioned areas is before parliament. Turkey’soverall level of preparedness in the area of capital movements and payments is limited.No progress can be reported on further alignment of Turkey’s payment systems legislationwith the acquis. The Central Bank revised its communiqué on use of the IBAN (internationalbank account number) in bank transfers, making its use in practice optional if the recipient’sIBAN is unknown. Adoption of a new payment systems law in line with the acquis ispending. The overall level of preparedness in payment systems remained incomplete.Progress has been made on alignment with the acquis on the fight against moneylaundering. A number of regulations have been adopted to implement the 2006 Law on theprevention of laundering proceeds of crime and the 2008 action plan, which is a key elementfor the accession negotiations in this chapter. A regulation introduced detailed provisions oncustomer identification, including real persons, legal persons and entities and electronictransfers. Another regulation adopted allows obliged parties to take simplified measures interms of customer due diligence. The Ministry of Finance is authorised to decideimplementing measures and the types of transactions falling within the scope of thisregulation.EN 49 EN
