levels were put in place. No progress has been made towards establishing a nationalenvironment agency. Administrative capacity needs further strengthening, includingcoordination between the relevant authorities at all levels. Environmental protectionrequirements are still not taken into account in the framing of policies and in theimplementation of infrastructure projects.ConclusionOverall, progress was made towards further alignment. Preparations in the field ofenvironment are at an early stage. Turkey has made good progress on waste managementwhereas limited progress can be reported on horizontal legislation, air and water quality,industrial pollution, chemicals and administrative capacity. Turkey has made very limitedprogress as regards climate change and no progress in the area of nature protection. Turkeymade progress on administrative capacity by putting in place mechanisms to coordinate theadministrative bodies at different levels in this field. Investments in the field of theenvironment need to be increased.4.28. Chapter 28: Consumer and health protectionThere has been little progress in the area of consumer protection. The consumer movementis still weak and does not receive government support. Better dialogue as well as activeparticipation by NGOs in policy- and law-making mechanisms needs to be ensured, butgovernment activity is low in this respect.Some progress can be reported in the field of product safety-related issues. TheUndersecretariat for foreign trade issued legislation streamlining surveillance reports andnotifications. A national market surveillance strategy for <strong>2010</strong>-2012 was adopted. Marketsurveillance activities have continued to increase and the Undersecretariat’s report on marketsurveillance activities performed in 2009 is a notable step towards the systematic collection ofcomparable data. The use of risk assessment methods, which would help optimise the use oflimited market surveillance budgets, remains insufficient, as is evaluation of the effectivenessof actions. Market surveillance needs to be further improved through enhanced visibility,involvement of consumer organisations and awareness among the general public of theconcept of risky products, as well as better coordination within and between surveillanceagencies, including the use of IT tools. The revision of the general product safety legislation ispending, which is a key element for the accession negotiations in this chapter. [See Chapter 1]There has been little progress in the area of non-safety related issues. Adoption of theconsumer protection law is pending too, which is a key element for the accession negotiationsin this chapter. The consumer portal providing e-application services to consumers for theircomplaints has been made operational. Consumers can now file their complaintselectronically and the complaint is directed to the consumer arbitration committee. This is apositive step to speed up the arbitration process and ease access to information for theconsumer courts. Follow-up of the decisions of the advisory Consumer Council, andconsistent legal interpretation of the consumer laws by the courts and arbitration committeesneed to be ensured. Specialisation of the arbitration committees needs to be improved.Some progress can be reported in the field of public health.Regarding horizontal aspects, the Ministry of Health published its first strategic plan,covering the years <strong>2010</strong>-2014. The plan aims to improve and enhance the well-being ofsociety by combating threats to health, improving the safety and quality of health services,EN 91 EN
