The building work done will be charged for on the basis of theprices of the Leistungsverzeichnis (Works Schedule)*2. The prices which apply are those of the " Leistungsverzeichnis zumRahmenbauvertrag Bunkerbau West" (Works Schedule to the Frame-BuildingContract, Pill-boxes, West), issue of June 1943* They are contractprices in the sense as defined in the Auftragsbedingungen (JobSpecifications) para. 15 V*3. Modifications of the section PI of the contract prices aregoverned by Section IB of the preamble to the Leistungsverzeichnis(Works Schedule). Sections Ps of the prices to be changed are to formthe basis, without alteration, of the charge in accordance withJob Specifications Para 14, section 9, in conjunction with JobSpecifications Para. 16, No* HI*4* For modifications of the sections PI of the contract prices, themodifioafclonfactors (see preamble to the Works Schedule, Section IB)are fixed atF 1 = 0.60 and F 2 = 1.60-69

For ascertaining the supplementary prices, the same regulationswith the supplements for overtime and general expenses, as inascertaining prices for the contract, are to be employed*6. If works be<strong>com</strong>e necessary which are not provided for in theWorks Schedule, the prices for these extra-contractual works must beagreed upon between the HU and theNU before the work is started.Such agreements require the approval of the OBL.Para, 3 - Pegging Out and Measuring1. The fixing of all pegging, measuring and height figures onthe ground which are necessary for the calculations, must be undertakenby the NU, with the collaboration of the HU, with full responsibilityfor their correctness. The NU must see to it that the checking of thepegging and of the work done can be easily carried out by the buildingcontrol*2. When measurements which are to serve as basis for chargesare made a representative of OBL must always be present.3. For all measurements, etc. the necessary labour, measuringinstruments, levels, etc. must be provided by theNU at its own cost,and if possible from its own stocks.4. In the event of infringement of the foregoing orders, themeasurements and the decisions of the OBL will prevail.Para. 4 - Tariff Conditions1. Whenever possible the NU must carry out its work to the greatestextent according to the Output Pay Principle (Reichstarif-Ordnungttber den Leistungslohn im Baugewerbe, 2 June 1942 and Anordnung desBeauftragten d«s Sondertreuhftnders bei E.G.W, 20 April 1943)»Para. 5 - Relation of theNU to the 0T1. In relations with the 0T, the HU is tne sole contracting party.2. TheHU is entitled, in connection with the <strong>com</strong>pletion andcontinuation of the building work, to issue instructions with whichtheNU must <strong>com</strong>ply. If the NU considers that the instructionsof the HU are unsuitable, it may appeal through the OBL to the 0T,whose decision is final.3» TheNU is in all respects entirely responsible in its sectorand within the scope of its order for the carrying out and <strong>com</strong>pletionof the building work. For the carrying out of the building work itwill remain in constant touch with the HU. The latter will, as ageneral rule, only have to intervene if the steps taken by theNUappear to theHU to be inappropriate and inadequate.4» The 0T has the right to entrust third parties with theexecution of tne rights arising under this contract, or to authoriseGovernment Departments to take its place in this contract.Para. 6. - Services and Remuneration of theHU1. TheHU undertakes to render the following services to the NU:(a)It organises, and arranges for, the supply of allbuilding material, building fuel and auxiliary buildingmaterial, and arranges, as may be necessary, for theprovision of railway wagons at the appropriate places.- 70
