Nainital. This enabled the Committee to focus on these broad categories as reasons/grounds for<br />

challenging the action of <strong>Public</strong> <strong>Service</strong> Commissions.<br />

The five broad categories, approved by other Chairpersons are:<br />

1. Questioning the validity of the Government Rules, Orders, notifications, etc., relating to<br />

recruitment of Civil Servants.<br />

2. Questioning the validity of the notification inviting applications or orders made or action<br />

taken by the Commission during the course of selection process.<br />

3. Questioning the correctness of action taken by the Chairman and Members in awarding<br />

marks or preparing the select lists.<br />

4. Staff of the Commission challenging the orders relating to their service conditions, and<br />

5. Challenging some action relating to appointment, seniority and the like taken by the<br />

Government in relation to persons selected by the Commission subsequent to the selection<br />

by the Commission where the Commission is made a formal party.<br />

PROBLEMS FACED BY THE PUBLIC SERVICE COMMISSIONS<br />

In spite of the best efforts made by the <strong>Public</strong> <strong>Service</strong> Commission to maintain its integrity, unsuccessful<br />

candidates do find faults with its functioning. So the objective of the <strong>Public</strong> <strong>Service</strong> Commissions shall<br />

be to see how best they could visualize the possible ways the candidates might interpret the rules,<br />

notifications, orders and decisions of the <strong>Public</strong> <strong>Service</strong> Commission and make these things simple,<br />

specific and objective. This will certainly help in reducing the number of litigations. Considering the<br />

huge task and responsibility of the <strong>Public</strong> <strong>Service</strong> Commissions in its functioning a few litigations are<br />

inevitable. In fact they are healthy also. However, the number of cases in different courts is very high<br />

which seems to point towards certain flaws in some areas of administration. Strict compliance with the<br />

procedure would itself vastly reduce the litigation in many areas. So the main task before all the State<br />

Commissions is, to reduce, if not, eliminate, litigation.<br />

The two main grounds for focusing the attention of all <strong>Public</strong> <strong>Service</strong> Commissions are, in the first<br />

instance, how litigation can be reduced and the second, what additional steps are required to be<br />

undertaken by the Commission in order to maintain the reputation. The cost factor for both Commission<br />

and the petitioner candidates has to be reduced. The Commissions could think of conducting general<br />

orientation programmes or awareness programmes for candidates before they apply for any post. In<br />

this electronic era, the same may be conducted through Tele conference.<br />
