RESULT OF ANALYSIS:<br />

All the above and many more such cases suggest that either there are lacunae found by the courts<br />

in the system which is in operation or that the grounds on which the candidates have approached the<br />

courts are frivolous and vexatious.<br />

To plug such cases, the Commissions have to work out modalities to be followed in the process of<br />

recruitment. Conducting examinations and recommending the candidates for recruitment to Civil<br />

<strong>Service</strong>s, is a paramount constitutional duty. This has to be discharged sincerely, methodically and<br />

without doing any injustice to any candidate. Utmost care has to be taken before the process is<br />

launched.<br />

SUGGESTIONS:<br />

The Legal Committee has identified the following as the main reasons for increase in Court cases:<br />

a) Defect/ambiguity in recruitment rules<br />

b) Defect in recruitment notifications<br />

c) Incomplete applications<br />

d) Wrong questions<br />

e) Wrong key answers<br />

f) Disparity in valuation<br />

g) Preparation of select list as per reservation policy<br />

Keeping in mind the problems identified in the earlier paragraphs, the following suggestions are<br />

submitted for consideration of the National Conference of the Chairpersons of <strong>Public</strong> <strong>Service</strong><br />

Commissions.<br />

The problems can be grouped as under:<br />

Group - A<br />

Stage of issuing notification/order/rules of the Government for recruitment.<br />

Group - B<br />

Issuing notification inviting applications for the posts to be filled up.
