The Committee on Climate Change is charged with regularly assessing progress in respect of the UK adaptation programme. Similarly, in Scotland the UK Committee on Climate Change or its Scottish counterpart will perform this function. In Northern Ireland, by contrast, it will be for the relevant department preparing the adaptation programme to assess its own progress over time. One key element of the climate change legislation in relation to adaptation concerns the duties of public bodies. This is most striking under the Scottish Act, which imposes a duty on public bodies to exercise their functions in a way best calculated to deliver on the Scottish adaptation programme, and which allows the Scottish Government to issue directions requiring these bodies to report on compliance. 6 The Scottish Government may establish a body to monitor compliance by public bodies with their climate change obligations. Under the UK Act, the Secretary of State or the Welsh Ministers may issue guidance to ‘reporting authorities’ (statutory undertakers or bodies with functions of a public nature) or direct them to produce adaptation reports, including an assessment of the impact of climate change in relation to that authority’s functions, together with proposals and policies for adaptation. Joint reporting by more than one authority may also be required. No equivalent powers to issue guidance and directions to public bodies are laid down for Northern Ireland. In accordance with the terms of the UK Act, the Secretary of State has laid a statutory report before Parliament setting out the Government’s strategy for using the reporting power and a list of priority reporting authorities. 7 As more than 100,000 authorities are eligible for direction under the reporting power, the Government has identified about 90 authorities that will be required to report in the first round. In 2008 the Government set up the cross-departmental Adapting to Climate Change (ACC) Programme to co-ordinate work from all areas of government and the wider public sector in England and the UK for reserved matters. Figure 3-I illustrates the governance structure of the programme. Government departments are represented at senior level on a Programme Board, which oversees the work of the ACC Programme (and is part of that Programme in terms of Figure 3-I). This Board aims to ensure engagement across Whitehall and determine priorities for the ACC Programme, including the initiation of joint projects across departments. The Programme reports upwards to the Climate Change and Energy Delivery and Strategy High-level Board (the DASH Board), which is responsible for the delivery of the Government’s climate change and energy objectives. The DASH Board reports to the Cabinet Sub-Committee on Environment and Energy (ED(EE)). As adapting to climate change forms one of the Department for Environment, Food and Rural Affairs’ (Defra’s) Departmental Strategic Objectives, Defra is also responsible for providing the ACC Programme delivery team. After its formation in 2008, the ACC Programme established a Local and Regional Adaptation Partnership (LRAP) Board, which acts as a focal point for bringing together representatives from local and regional government with key institutions such as the UK Climate Impacts Programme (UKCIP) and the Environment Agency. In addition to LRAP the ACC Programme also established a Partnership Board to engage with wider stakeholder groups from across the private and public sectors and to ensure external advice is incorporated. Finally, the UK Adaptation Group supports collaboration across national efforts on adaptation and addresses any shared issues by linking with representatives from the Devolved Administrations of Scotland, Wales and Northern Ireland. 36
