<strong>PHMSA</strong> received one comment from the FCHEA requesting that we amend<br />

§ 175.10(a)(19) to allow fuel cell cartridges containing flammable gas in Division 2.1 and<br />

fuel cells containing water reactive materials in Division 4.3 in checked passenger<br />

baggage. <strong>PHMSA</strong> did not propose changes to the provisions allowing for the checking <strong>of</strong><br />

limited types <strong>of</strong> fuel cells in the NPRM, and consider this request to be outside the scope<br />

<strong>of</strong> this rulemaking.<br />

PRBA noted in their comments to the NPRM that the 2013-2014 ICAO Technical<br />

Instructions contain a provision that authorizes passengers to carry portable medical<br />

electronic devices aboard passenger aircraft with lithium metal batteries containing up to 8<br />

grams <strong>of</strong> lithium metal. While this amendment should be added to the HMR it was not<br />

included in the August 15, 2012 NPRM and the public has not been provided notice <strong>of</strong> any<br />

intent to add a new exception for lithium battery-containing portable medical devices in §<br />

175.10 or afforded the opportunity to provide us with written data, views, or arguments to<br />

aid our decision. As the FAA Modernization and Reform Act <strong>of</strong> 2012 requires<br />

harmonization in this instance, we will propose to adopt this exception in a future<br />

rulemaking.<br />

Part 176<br />

Section 176.2<br />

Section 176.2 provides definitions <strong>of</strong> terms specifically as they pertain to Part 176.<br />

In this final rule, <strong>PHMSA</strong> is adopting various revisions to the vessel stowage and<br />

segregation requirements specified in Part 176. As part <strong>of</strong> these changes certain<br />

terminology must be defined.<br />
