Chemical under pressure:<br />

In the NPRM, <strong>PHMSA</strong> proposed to amend the HMT to include individual entries<br />

for chemical under pressure and incorporate other safety requirements including, but not<br />

limited to, quantity and filling limits and packaging and segregation requirements.<br />

<strong>PHMSA</strong> received one comment on this proposal from 3M in support <strong>of</strong> the proposals to<br />

add entries for chemical under pressure. 3M requested we authorize the use <strong>of</strong> non-<br />

refillable cylinders larger than 1.25 liters containing flammable gas consistent with the UN<br />

Model Regulations. <strong>PHMSA</strong>’s intent regarding the chemical under pressure entry was to<br />

comprehensively align the requirements <strong>of</strong> this entry with international standards. In this<br />

final rule we are revising the packaging requirements for chemical under pressure to<br />

authorize the use <strong>of</strong> non-refillable cylinders larger than 1.25 liters for chemical under<br />

pressure.<br />

Aircraft Batteries:<br />

In the NPRM, <strong>PHMSA</strong> proposed to revise the HMR to permit the transport <strong>of</strong> wet<br />

cell aircraft batteries and lithium ion aircraft batteries aboard passenger aircraft in excess<br />

<strong>of</strong> the quantity limited specified in column 9A <strong>of</strong> the HMR. <strong>PHMSA</strong> received comments<br />

from Saft and PRBA in support <strong>of</strong> these proposed amendments because these changes<br />

would further harmonize the HMR with the ICAO Technical Instructions. Both Saft and<br />

PRBA cite a requirement in the "FAA Modernization and Reform Act <strong>of</strong> 2012” (§ 828,<br />

Pub. L 112-95; 126 Stat. 133 (Feb 14, 2012)) (FAA Modernization and Reform Act <strong>of</strong><br />

2012) that states the Secretary <strong>of</strong> <strong>Transportation</strong>, including a designee <strong>of</strong> the Secretary,<br />
