changes to regulatory text language to eliminate confusion that these items may only be<br />

able to be transported as cargo. <strong>PHMSA</strong> has revised the language in §§ 173.159a,<br />

173.162, 173.175, 173.219, and 173.306 to be consistent with the language in special<br />

provision A200 that these excepted articles, items and materials must be transported as<br />

cargo and cannot be carried onboard an aircraft by passengers or crewmembers as carry-on<br />

baggage, checked baggage, or on their person unless specifically excepted by § 175.10.<br />

<strong>PHMSA</strong> received one comment from the FCHEA requesting that we amend §<br />

175.10(a)(19) to allow fuel cell cartridges containing flammable gas in division 2.1 and<br />

fuel cells containing water reactive materials in division 4.3 in checked passenger baggage.<br />

<strong>PHMSA</strong> did not propose changes to the provisions allowing for the checking limited types<br />

<strong>of</strong> fuel cells in the NPRM, and consider this request to be outside the scope <strong>of</strong> this<br />

rulemaking.<br />

Section 173.4b<br />

This section specifies exceptions for materials packaged in de minimus quantities.<br />

In the NPRM, <strong>PHMSA</strong> proposed and is subsequently adopting in this final rule, an<br />

exception in § 175.10(a)(22) to permit non-infectious specimens packaged in accordance<br />

with § 173.4b(b) to be carried aboard an aircraft by passengers and crewmembers in<br />

checked or carry-on baggage or on their person. In the NPRM we inadvertently neglected<br />

to revise the language in § 173.4b(b)(8) to recognize this exception. In this final rule,<br />

<strong>PHMSA</strong> is revising § 173.4b(b)(8) to reference the adopted exception in § 175.10(a)(22).<br />

Section 173.12<br />

This section specifies the exceptions for shipment <strong>of</strong> waste materials including the<br />

requirements for waste packages known as “lab packs.” A lab pack, although not<br />
