Packagings, the criterion that a fiberboard or wooden Large Packaging must meet to be<br />

considered as successfully passing the stacking test is omitted.<br />

Therefore, in this final rule, we are correcting this omission, by adding a new<br />

paragraph (e)(2) that addresses the criterion for fiberboard or wooden Large Packagings to<br />

pass the test and redesignating the following paragraphs accordingly.<br />

Subpart R<br />

Currently, the HMR do not contain specifications for FBCs. In this final rule,<br />

<strong>PHMSA</strong> is adopting the specification, construction, and testing requirements for FBCs.<br />

On February 2, 2010, <strong>PHMSA</strong> published a final rule in the Federal Register under Docket<br />

Number <strong>PHMSA</strong>–2006– 25736 (HM-231) [75 FR 4699] entitled “Hazardous Materials;<br />

Miscellaneous Packaging Amendments.” In HM-231, specification and testing<br />

requirements were adopted for Large Packagings. The specification and testing<br />

requirements for FBCs are modeled on the regulatory structure adopted for Large<br />

Packagings in HM-231. Thus, new subpart R <strong>of</strong> part 178 entitled “Subpart R—Flexible<br />

Bulk Container Standards” is added.<br />

Section 178.1000<br />

<strong>PHMSA</strong> is adopting new § 178.1000 entitled “Purpose and scope.” This section<br />

prescribes the packaging designs to which Subpart R applies and the location in the HMR<br />

where terms used in the subpart are defined.<br />

Section 178.1005<br />

In this final rule, <strong>PHMSA</strong> is adding new § 178.1005 entitled “Flexible Bulk<br />

Container Identification <strong>Code</strong>.” This section provides the identification code (i.e. BK3)<br />
