Section 176.600 prescribes detailed requirements for Division 2.3 (Poisonous Gas)<br />

and Division 6.1 (Poisonous) materials transported by vessel. Paragraph (d) <strong>of</strong> this section<br />

requires each package <strong>of</strong> Division 2.3 (poisonous gas) material or Division 6.1 (poison)<br />

material that also bears a FLAMMABLE LIQUID or FLAMMABLE GAS label must be<br />

stowed in a mechanically ventilated space, kept as cool as reasonably practicable, and be<br />

stowed away from all sources <strong>of</strong> heat and ignition.<br />

<strong>PHMSA</strong> is revising paragraph (d) to replace “stowed away from all sources <strong>of</strong> heat<br />

and ignition” with “protected from sources <strong>of</strong> heat and stowed away from potential sources<br />

<strong>of</strong> ignition.” These changes incorporate the definitions <strong>of</strong> “protected from sources <strong>of</strong> heat”<br />

and “potential or possible sources <strong>of</strong> ignition.”<br />

<strong>PHMSA</strong> received one comment from Horizon requesting that the mechanically<br />

ventilated space and protected from sources <strong>of</strong> ignition stowage requirements be applied<br />

only to 2.3 materials and 6.1 materials that are toxic by inhalation. The proposal in the<br />

NPRM was done solely to change the terminology based on the adoption <strong>of</strong> new<br />

international definitions for “protected from sources <strong>of</strong> heat” and “potential or possible<br />

sources <strong>of</strong> ignition.” No changes to the actual commodities that require such segregation<br />

were proposed or will be implemented in this rulemaking.<br />

Section 176.907<br />

Section 176.907 is created to incorporate cargo transport requirements for<br />

shipments <strong>of</strong> UN2211, Polymeric Beads, Expandable evolving flammable vapor and<br />

UN3314, Plastics Molding Compound in dough, sheet or extruded rope form, evolving<br />

flammable vapor. Several cases <strong>of</strong> damage to cargo transport units were presented to the<br />

IMO with the root cause being identified as the release <strong>of</strong> flammable pentane gas during<br />
