Section 178.1010<br />

In this final rule, <strong>PHMSA</strong> is adding new § 178.1010 entitled “Marking <strong>of</strong> Flexible<br />

Bulk Containers.” This section prescribes the markings the manufacturer <strong>of</strong> an FBC must<br />

mark on a package to indicate the FBC meets the specification. The marking requirements<br />

for FBCs are based on the current marking requirements for IBCs prescribed in § 178.703.<br />

Section 178.1015<br />

In this final rule, <strong>PHMSA</strong> is adding new § 178.1015 entitled “General Flexible<br />

Bulk Container Standards.” This section prescribes the general packaging integrity<br />

requirements an FBC design must meet.<br />

Section 178.1020<br />

In this final rule, <strong>PHMSA</strong> is adding new § 178.1020 entitled “Period <strong>of</strong> use for<br />

transportation <strong>of</strong> hazardous materials in Flexible Bulk Containers.” This section prescribes<br />

the length <strong>of</strong> time an FBC may be used to package hazardous materials. Specifically, this<br />

section states that an FBC used to package hazardous materials may remain in service not<br />

to exceed two years from the date <strong>of</strong> manufacture.<br />

Subpart S<br />

Currently, the HMR do not prescribe testing criteria for FBCs. <strong>PHMSA</strong> is adopting<br />

testing protocol for FBCs. On February 2, 2010, <strong>PHMSA</strong> published a final rule in the<br />

Federal Register under Docket Number <strong>PHMSA</strong>–2006– 25736 (HM-231) [75 FR 4699]<br />

entitled “Hazardous Materials; Miscellaneous Packaging Amendments.” In HM-231,<br />

specification and testing requirements were adopted for Large Packagings. The test<br />

protocol proposed in this final rule for FBCs are modeled on the regulatory structure<br />
