Section 176.400<br />

Section 176.400 prescribes stowage requirements for Division 1.5, Class 4<br />

(flammable solids) and Class 5 materials transported by vessel. Paragraph (a) requires<br />

Class 4 (flammable solid) material and Division 5.2 (organic peroxide) materials to be kept<br />

as cool as reasonably practicable and be stowed away from all sources <strong>of</strong> heat and ignition.<br />

<strong>PHMSA</strong> is revising paragraph (a) to read “Class 4 (flammable solid) material and<br />

Division 5.2 (organic peroxide) material must be kept as cool as reasonably practicable,<br />

protected from sources <strong>of</strong> heat, and away from potential sources <strong>of</strong> ignition.” These<br />

changes incorporate the definitions <strong>of</strong> “protected from sources <strong>of</strong> heat” and “potential or<br />

possible sources <strong>of</strong> ignition.”<br />

Paragraph (b) <strong>of</strong> this section requires Division 5.2 (organic peroxide) material to be<br />

stowed away from living quarters or access to them. Division 5.2 (organic peroxide)<br />

substances not requiring temperature control should be protected from radiant heat, which<br />

includes direct rays <strong>of</strong> the sun, and stowed in a cool, well-ventilated area.<br />

<strong>PHMSA</strong> is amending paragraph (b) to replace “should be protected from radiant<br />

heat, which includes direct rays <strong>of</strong> the sun, and stowed in a cool, well-ventilated area” with<br />

“must be protected from sources <strong>of</strong> heat, including radiant heat and strong sunlight, and<br />

must be stowed in a cool, well-ventilated area.” These changes are being made to<br />

incorporate the definitions <strong>of</strong> “protected from sources <strong>of</strong> heat” harmonize with the IMDG<br />

<strong>Code</strong>, and to emphasize that protecting shipments <strong>of</strong> organic peroxides not requiring<br />

temperature control from sources <strong>of</strong> heat is a requirement and not optional.<br />
