Section 178.1030<br />

In this final rule, <strong>PHMSA</strong> is adopting § 178.1030 entitled “Purpose and scope.”<br />

This section prescribes the applicability to which the Subpart S tests apply.<br />

Section 178.1035<br />

In this final rule, <strong>PHMSA</strong> is adopting § 178.1035 entitled “General requirements.”<br />

This section prescribes the general packaging requirements for FBCs and addresses the<br />

following topics: FBC-related definitions; defining responsibility for compliance with<br />

specification requirements; design qualification testing; periodic design testing; pro<strong>of</strong> <strong>of</strong><br />

compliance; and record retention.<br />

Section 178.1040<br />

In this final rule, <strong>PHMSA</strong> is adopting test preparation requirements for FBCs in<br />

new § 178.1040 entitled “Preparation <strong>of</strong> Flexible Bulk Containers for Testing.” This<br />

section specifies the general test preparation requirements applicable to all tests an FBC is<br />

required to successfully pass.<br />

Section 178.1045<br />

In this final rule, <strong>PHMSA</strong> is adopting requirements for drop tests conducted on<br />

FBCs. A drop test is used to measure a packaging’s ability to withstand falls from specific<br />

heights and is used to determine if a package is suitable to transport hazardous materials.<br />

Thus, <strong>PHMSA</strong> is adding a new § 178.1045 entitled “Drop test.” This section prescribes<br />

the preparation <strong>of</strong> test samples, test methods authorized, drop heights, and criteria for<br />

passing the drop test.<br />
