exception for goods <strong>of</strong> division 1.4, but sees no need to extend the exception beyond what<br />

is authorized by the international standard.<br />

This minimum distance for explosive shipment stowage from the ship’s side is<br />

adopted to harmonize with a recent change in the IMDG <strong>Code</strong> and provides an increased<br />

level <strong>of</strong> safety by ensuring explosive shipments are not stowed adjacent to the ships<br />

internal structure.<br />

Paragraph (f) previously indicated general stowage provisions for HMT explosive<br />

entries stowed under deck and assigned stowage category 09 or 10. The removal <strong>of</strong><br />

stowage category 09 and 10 make these provisions no longer applicable.<br />

Section 176.128<br />

Section 176.128 defines the varying levels <strong>of</strong> containment for explosives identified<br />

as magazine stowage types “A”, “C,” and “Special Stowage.” The IMO has determined<br />

that a distinction between closed cargo transport units and magazines is no longer<br />

necessary. <strong>PHMSA</strong> concurs with the IMO on this issue and is deleting § 176.128 and<br />

reserving it for future use. With the addition <strong>of</strong> a definition for “closed cargo transport unit<br />

for Class 1,” and the requirement for all explosive shipments to be stored at a distance at<br />

least equal to one eighth <strong>of</strong> the beam <strong>of</strong> the vessel or 2.4 m (8 feet), whichever is less,<br />

specific requirements for type A, C, and special magazine stowage are now unnecessary.<br />

Note that portable magazines remain authorized by § 176.137 and the definition <strong>of</strong> “closed<br />

cargo transport unit for Class 1.”<br />

Section 176.130<br />

Section 176.130 prescribes requirements for magazine stowage type A. The IMO<br />

determined that a distinction between closed cargo transport units and magazines is no<br />
