Cases, cartridge, empty with primer refers to small arms cartridges with no bullet or<br />

propellant but with a primer, just an empty primed case. SAAMI stated that Cases,<br />

cartridge, empty with primer <strong>of</strong> 50 caliber or less clearly meet the intent and equivalent<br />

level <strong>of</strong> safety to products already referenced in 173.56(h).<br />

<strong>PHMSA</strong> is amending §173.56(h) to ensure Cartridges for tools, blank that meet the<br />

conditions <strong>of</strong> that paragraph are excepted from the requirements <strong>of</strong> the rest <strong>of</strong> this section.<br />

<strong>PHMSA</strong> believes this to be a natural extension <strong>of</strong> the intent <strong>of</strong> the exception in §173.56(h)<br />

as well as a necessary domestic change that is a direct result <strong>of</strong> international rulemaking.<br />

<strong>PHMSA</strong> will not be adding Cases, cartridge, empty with primer to §173.56(h).<br />

<strong>PHMSA</strong> believes Cases, cartridge, empty with primer to be materially different from those<br />

articles currently authorized for the exception in §173.56(h). The proposed addition <strong>of</strong><br />

Cases, cartridge, empty with primer to §173.56(h) is also not a direct result <strong>of</strong> international<br />

rulemaking and this rulemaking vehicle is not suited for such a proposal.<br />

Section 173.59<br />

Section 173.59 provides definitions <strong>of</strong> explosive terms related to the transport and<br />

classification <strong>of</strong> explosives used throughout subpart C <strong>of</strong> part 173. These definitions are<br />

intended for information only and are not to be used for purposes <strong>of</strong> classification or to<br />

replace proper shipping names prescribed in § 172.101. In the UN Model Regulations,<br />

Appendix B to Chapter 3 contains a similar list <strong>of</strong> explosive definitions which are also<br />

intended for information only and are not to be used for purposes <strong>of</strong> hazard classification.<br />

In April 2010, the United States and the United Kingdom submitted a formal<br />
