Section 176.138 prescribes general requirements for on deck stowage. Paragraph<br />

(b) provides general requirements for on deck stowage <strong>of</strong> explosives. In this final rule,<br />

<strong>PHMSA</strong> is revising this section to require explosives to not be stowed within 6 m (20 feet)<br />

<strong>of</strong> the newly defined term “any potential sources <strong>of</strong> heat or ignition.” This change is<br />

adopted to incorporate a newly defined term in § 176.2. <strong>PHMSA</strong> received one comment<br />

from IVODGA requesting an editorial clarification to separate the proposed language into<br />

“from any source <strong>of</strong> heat and any possible sources <strong>of</strong> ignition” and is making the requested<br />

change.<br />

Section 176.144<br />

Section 176.144 prescribes segregation requirements for Class 1 materials<br />

transported by vessel. Paragraph (d) allows materials requiring ordinary stowage (non-<br />

magazine stowage) to be stowed in the same magazine as materials requiring magazine<br />

stowage. <strong>PHMSA</strong> is revising paragraph (d) to state that if part <strong>of</strong> a shipment requires non-<br />

metallic lining <strong>of</strong> closed cargo transport units, Class 1 materials requiring ordinary stowage<br />

(stowage not requiring non-metallic lining <strong>of</strong> closed cargo transport units) may be stowed<br />

in the same closed cargo transport unit provided there are no exposed parts <strong>of</strong> any ferrous<br />

metal or aluminum alloy, unless separated by a partition. The removal <strong>of</strong> sections and<br />

requirements for magazine stowage necessitates the change in this section.<br />

During the review <strong>of</strong> the NPRM <strong>PHMSA</strong> noted that Table 176.144(a) includes a<br />

reference to explosives requiring special stowage in Note: 1. This final rule removes the<br />

special stowage section in the HMR. Therefore, <strong>PHMSA</strong> is removing the reference to<br />

special stowage in Note 1 <strong>of</strong> Table 176.144(a).<br />
