FBCs must be transported in a conveyance with rigid sides and ends that extend at least<br />

two-thirds the height <strong>of</strong> the FBC, must not be <strong>of</strong>fered for transportation in freight<br />

containers, and may not exceed 15 cubic meters in capacity.<br />

Section 173.50<br />

Section 173.50 provides definitions for the various divisions <strong>of</strong> Class 1 (explosives)<br />

referenced in Subpart C <strong>of</strong> Part 173. Paragraph (b) <strong>of</strong> this section notes that Class 1<br />

(explosives) are divided into six divisions. Division 1.6 is described as an explosive<br />

consisting “<strong>of</strong> extremely insensitive articles that do not have a mass explosive hazard. This<br />

division is comprised <strong>of</strong> articles that contain only extremely insensitive detonating<br />

substances and that demonstrate a negligible probability <strong>of</strong> accidental initiation or<br />

propagation.”<br />

In this final rule, <strong>PHMSA</strong> is removing the word “detonating” from this definition to<br />

align with the revised definition provided in the 17th Revised Edition <strong>of</strong> the UN Model<br />

Regulations.<br />

Section 173.56<br />

Section 173.56 prescribes the definition <strong>of</strong> new explosives and provides explosive<br />

(Class 1) classification and approval requirements. Paragraph (h) <strong>of</strong> § 173.56 states that<br />

small arms ammunition, within certain parameters is not subject to the approval<br />

requirements <strong>of</strong> the rest <strong>of</strong> §173.56.<br />

<strong>PHMSA</strong> received a comment from SAAMI requesting that <strong>PHMSA</strong> amend<br />

§ 173.56 to except Cases, cartridge, empty with primer and Cartridges for tools, blank<br />

from the approval requirements <strong>of</strong> § 173.56. SAAMI noted that for Cartridges for tools,<br />

blank the switch from UN 0323 to UN 0014 could necessitate new EX approvals for<br />
