The cost of a due process hearing or other legal proceeding that results from special education<br />

issues shall be the responsibility of the district as it would with legal proceedings involving other district<br />

schools. Integrity Educational Center shall not initiate a due process hearing or other legal proceeding<br />

related to special education without the written consent of the district superintendent or their designee.<br />

FUNDING:<br />

The parties agree that, pursuant to the division of responsibilities set forth in this agreement, the<br />

Integrity Educational Center has elected, at least for its first year of operation, the status of any other<br />

blic school in the district for purposes of Special Education services for the school, consistent with<br />

it provides at its public schools that shall be consistent with the division of responsibility. The<br />

district shall retain all State and Federal Special Education funding allocated for IEC students through<br />

SELPA. The district shall be responsible for all costs related to the service of IEC students in the same<br />

manner, as it is responsible for the cost of serving other students of the district.<br />

In compliance with Education Code section 47646 (C), the charter school will contribute a<br />

equitable share of its charter school, block grant funding to support district wide special education<br />

instruction and services. The exact figure will be calculated by the district and communicated to IEC no<br />

later than March of each year for the subsequent year in order to allow for adequate financial planning.<br />
