SUSPENSION- EXPULSION OF STUDENTS WITH EXCEPTIONAL NEEDS<br />

When suspensions involve a student who has been identified as an individual with a disability, or<br />

for whom the charter school has a basis on knowledge of a suspected disability pursuant to the<br />

individuals with disabilities Act ("IDEA") or who qualifies for services under section 504 of the<br />

Rehabilitation ACT of 1973 ("Section 504"), a manifestation determination meeting shall be held no later<br />

than the 10`11 suspension day (whether consecutive or cumulative for the school year) or upon the<br />

commencement expulsion proceedings. The manifestation determination meeting shall include OUSD,<br />

the parent and the relevant members of the student's IEP Team (as determined by the parent and OUSD).<br />

Integrity Educational Center will follow the requirements of State and Federal laws regarding<br />

spension, expulsion of Special Education students, including but not limited to the requirements that a<br />

aifestation<br />

determination be made prior to any change of placement. While Special Education students<br />

are subject to suspension on the same grounds as general education students, special education students<br />

may be suspended for up to, but not more than ten consecutive school days if he or she poses an<br />

immediate threat to the safety of himself, herself, or others. Suspension will be imposed only when other<br />

means of correction fail to bring about proper conduct. This will be done through a positive behavior<br />

intervention plan developed by the IEP team. In the event that a special education student commits one of<br />

the acts enumerated in the grounds for suspension or expulsion, she or he is subject to expulsion only if all<br />

of the following conditions are met:<br />

• The IEP team determines that misconduct was not caused by, or was not a direct manifestation of,<br />

the student's identified disability.<br />

• The team determines that the student had been appropriately placed at the time the misconduct<br />

occurred. In order to make this determination, a manifestation determination meeting will be held.<br />
