SUSPENSION AND EXPULSION CONTINUED:
I: MANAGEMENT CAPACITY
• Committ a sexual assault as defined in penal code 261,266c,286,288,288a or 289, or committ a
sexual battery as defined in Penal Code 243.4
• Harass, threaten , or intimidate a student who is a complaining witness or witness in a school
disciplinary proceeding for preventing that student from being a witness and /or retaliating against
that student for being a witness.
• Make terrorist threats against school officials and/or school property as defined in Education Code
Section 48900.7
• Committ sexual harassment as defined in Education Code Section 212.5
• Cause or attempt to cause, threaten or intimidate a student or group of students .
• Unlawfully offer, arrange to sell, negotiate to sell or sold prescription drugs
) A student may be suspended or expelled for any of the above referenced acts such that it is related
to school activities including but not limited to the following:
• While on school grounds
• While going to or coming from school
• During the lunch period whether on or off the campus
• During, or while going to or coming from, a school-sponsored activity.
PROCEDURE FOR SUSPENSION /INFORMAL CONFERENCE:

Suspension shall be preceded by an informal conference conducted by the principal or there
designee with the student and his/her parent or guardian. At the conference, the student will be
informed of the reason for the disciplinary action and the evidence against him or her and will be
given the opportunity to present his /her version and evidence in his her/her defense. The
conference may be omitted if the principal or designee determines that an emergency exists. An
emergency involves a clear and present danger to the lives, safety or health of students or school
personnel. In the event the student is suspended without conference, the parent/guardian shall be
notified of the suspension and a conference will be requested as soon as possible.
