SUSPENSION AND EXPULSION CONTINUED:<br />

I: MANAGEMENT CAPACITY<br />

• Committ a sexual assault as defined in penal code 261,266c,286,288,288a or 289, or committ a<br />

sexual battery as defined in Penal Code 243.4<br />

• Harass, threaten , or intimidate a student who is a complaining witness or witness in a school<br />

disciplinary proceeding for preventing that student from being a witness and /or retaliating against<br />

that student for being a witness.<br />

• Make terrorist threats against school officials and/or school property as defined in Education Code<br />

Section 48900.7<br />

• Committ sexual harassment as defined in Education Code Section 212.5<br />

• Cause or attempt to cause, threaten or intimidate a student or group of students .<br />

• Unlawfully offer, arrange to sell, negotiate to sell or sold prescription drugs<br />

) A student may be suspended or expelled for any of the above referenced acts such that it is related<br />

to school activities including but not limited to the following:<br />

• While on school grounds<br />

• While going to or coming from school<br />

• During the lunch period whether on or off the campus<br />

• During, or while going to or coming from, a school-sponsored activity.<br />

PROCEDURE FOR SUSPENSION /INFORMAL CONFERENCE:<br />

Suspension shall be preceded by an informal conference conducted by the principal or there<br />

designee with the student and his/her parent or guardian. At the conference, the student will be<br />

informed of the reason for the disciplinary action and the evidence against him or her and will be<br />

given the opportunity to present his /her version and evidence in his her/her defense. The<br />

conference may be omitted if the principal or designee determines that an emergency exists. An<br />

emergency involves a clear and present danger to the lives, safety or health of students or school<br />

personnel. In the event the student is suspended without conference, the parent/guardian shall be<br />

notified of the suspension and a conference will be requested as soon as possible.<br />
