104 Did the council effectively manage its outsourced <strong>plann<strong>in</strong>g</strong> <strong>services</strong>?<br />

5.2 Sett<strong>in</strong>g up of the contractual arrangement<br />

To assess whether council had set up appropriate procedures to manage its<br />

outsourced <strong>plann<strong>in</strong>g</strong> function, we reviewed:<br />

the contract manager and <strong>plann<strong>in</strong>g</strong> contractor’s skills and experience<br />

the council’s and the <strong>plann<strong>in</strong>g</strong> contractor’s roles and responsibilities <strong>in</strong><br />

provid<strong>in</strong>g <strong>plann<strong>in</strong>g</strong> <strong>services</strong><br />

contractual arrangements.<br />

We did not review the rationale for outsourc<strong>in</strong>g the <strong>plann<strong>in</strong>g</strong> <strong>services</strong> or<br />

the tender process used to engage the <strong>plann<strong>in</strong>g</strong> contractor.<br />

5.2.1 Skills and experience<br />

In undertak<strong>in</strong>g their duties, planners have to manage the compet<strong>in</strong>g<br />

<strong>in</strong>terests of those apply<strong>in</strong>g for <strong>plann<strong>in</strong>g</strong> permits and those <strong>in</strong> the<br />

community. Planners must provide an impartial and professional service to<br />

both parties 47 . <strong>Council</strong>s rely on their town planner’s skills, experience and<br />

knowledge for professional <strong>plann<strong>in</strong>g</strong> advice.<br />

Qualifications<br />

The contract between the council and the <strong>plann<strong>in</strong>g</strong> contractor required him<br />

to be:<br />

suitably qualified<br />

able to demonstrate experience <strong>in</strong> adm<strong>in</strong>ister<strong>in</strong>g the relevant acts, codes<br />

and regulations<br />

eligible for admission to an appropriate professional<br />

association/<strong>in</strong>stitute.<br />

The <strong>plann<strong>in</strong>g</strong> contractor did not have formal town <strong>plann<strong>in</strong>g</strong> qualifications.<br />

He did, however, have extensive experience <strong>in</strong> local government (37 years)<br />

and town <strong>plann<strong>in</strong>g</strong> (28 years), and was also a member of several relevant<br />

<strong>in</strong>dustry associations.<br />

In recent advertisements for statutory planners, the council has stated that<br />

a tertiary qualification <strong>in</strong> town <strong>plann<strong>in</strong>g</strong> or associated field is mandatory.<br />
