84 Did the council have appropriate management arrangements for the delivery of its <strong>plann<strong>in</strong>g</strong> <strong>services</strong>?<br />

Decid<strong>in</strong>g to change a <strong>plann<strong>in</strong>g</strong> scheme is a significant decision because it<br />

affects the way <strong>in</strong> which land can be used and developed.<br />

Amendments to <strong>plann<strong>in</strong>g</strong> schemes take several months and <strong>in</strong>volve:<br />

assess<strong>in</strong>g requests<br />

seek<strong>in</strong>g authorisation from the M<strong>in</strong>ister for Plann<strong>in</strong>g to prepare the<br />

amendment (requirement s<strong>in</strong>ce 23 May <strong>2005</strong>)<br />

process<strong>in</strong>g the amendment which, <strong>in</strong> some cases, can <strong>in</strong>volve referr<strong>in</strong>g the<br />

amendment and submissions to an <strong>in</strong>dependent panel appo<strong>in</strong>ted by the<br />

M<strong>in</strong>ister for Plann<strong>in</strong>g35 adopt<strong>in</strong>g the amendment or adopt<strong>in</strong>g and approv<strong>in</strong>g the amendment if<br />

authorised by the M<strong>in</strong>ister for Plann<strong>in</strong>g.<br />

S<strong>in</strong>ce the approval of the scheme <strong>in</strong> <strong>1998</strong>, 12 amendments have been prepared<br />

by the council. These have followed council decisions to re-zone land, correct<br />

mistakes <strong>in</strong> the scheme and <strong>in</strong>troduce new strategic directions – for example,<br />

the w<strong>in</strong>d energy project.<br />

Of those 12 amendments:<br />

6 have been approved and changes <strong>in</strong>corporated <strong>in</strong>to the scheme<br />

3 have lapsed<br />

3 are on hold.<br />

Apart from these amendments, 7 more amendments have been prepared<br />

directly and approved by the M<strong>in</strong>ister for Plann<strong>in</strong>g. One further amendment<br />

prepared by VicRoads has also been approved.<br />

A council is not bound by a panel’s recommendation. However, it must<br />

consider the report. If a council then decides to adopt an amendment contrary<br />

to the panel’s recommendation, it must give reasons to the m<strong>in</strong>ister for do<strong>in</strong>g<br />

so.<br />

There is no right of review if the m<strong>in</strong>ister rejects an amendment submitted for<br />

approval by council.<br />

Amendments to the <strong>plann<strong>in</strong>g</strong> scheme: Case study 12<br />

The follow<strong>in</strong>g case study shows how the council made an <strong>in</strong>valid decision to<br />

amend its <strong>plann<strong>in</strong>g</strong> scheme. Its failure to act on the issues raised by the<br />

Victorian Government Solicitor, has resulted <strong>in</strong> the amendment laps<strong>in</strong>g. This<br />

amendment proposed a new council MSS.<br />
