108 Did the council effectively manage its outsourced <strong>plann<strong>in</strong>g</strong> <strong>services</strong>?<br />
Performance management<br />
Detailed <strong>in</strong>formation outl<strong>in</strong><strong>in</strong>g when and how the <strong>plann<strong>in</strong>g</strong> contractor’s<br />
performance would be assessed was <strong>in</strong>cluded <strong>in</strong> the contract. Cont<strong>in</strong>uous<br />
improvement by the contractor was to be monitored through the<br />
achievement of key performance <strong>in</strong>dicators.<br />
Details of the 16 <strong>in</strong>dividual service activities and 7 performance <strong>in</strong>dicators<br />
established for the <strong>plann<strong>in</strong>g</strong> contractor are shown <strong>in</strong> Appendix B of this<br />
report.<br />
Our review disclosed that service standards and performance <strong>in</strong>dicators<br />
<strong>in</strong>cluded <strong>in</strong> the contract were largely quantitative. They provided the<br />
council with clear expectations of process<strong>in</strong>g times for key activities, but<br />
did not provide sufficient measurable <strong>in</strong>dicators to enable the council to<br />
adequately assess the quality of the <strong>services</strong> delivered by the <strong>plann<strong>in</strong>g</strong><br />
contractor.<br />
The council was made aware of this deficiency <strong>in</strong> its <strong>plann<strong>in</strong>g</strong> <strong>services</strong><br />
contract (both the current and proposed contract) when the council’s<br />
<strong>plann<strong>in</strong>g</strong> <strong>services</strong> were subject to a Best Value review <strong>in</strong> October 2002 50 .<br />
The Best Value report <strong>in</strong>cluded recommendations that qualitative measures<br />
be <strong>in</strong>troduced to comprehensively assess the contractor’s performance. The<br />
council considered the Best Value report and, <strong>in</strong> pr<strong>in</strong>ciple, agreed with the<br />
f<strong>in</strong>d<strong>in</strong>gs. However, additional qualitative service standards were not<br />
<strong>in</strong>cluded <strong>in</strong> the proposed <strong>plann<strong>in</strong>g</strong> <strong>services</strong> contract.<br />
Examples of performance <strong>in</strong>dicators that could be used to assess the<br />
quality of the <strong>services</strong> provided by the contractor <strong>in</strong>clude:<br />
level of compliance by contractor with legislative requirements and<br />
council policies and procedures<br />
council satisfaction with <strong>services</strong> provided<br />
level of compla<strong>in</strong>ts received<br />
success rate of <strong>plann<strong>in</strong>g</strong> appeals<br />
level of VCAT appeals as a proportion of all <strong>plann<strong>in</strong>g</strong> decisions.<br />
The tender specification for town <strong>plann<strong>in</strong>g</strong> <strong>services</strong> dated November 2002<br />
further <strong>in</strong>dicated that all works and <strong>services</strong> were be to carried out to “…<br />
<strong>in</strong>dustry best practice standards, <strong>in</strong> compliance with relevant professional<br />
codes of conduct …” However, there was no def<strong>in</strong>ition of the relevant<br />
standards and codes to be applied <strong>in</strong> assess<strong>in</strong>g the <strong>plann<strong>in</strong>g</strong> contractor’s<br />
performance.<br />
