Recommendations<br />

12. In mak<strong>in</strong>g <strong>plann<strong>in</strong>g</strong> decisions, the council should endeavour to<br />

achieve an appropriate balance between its objective of<br />

promot<strong>in</strong>g economic development and its other objectives of<br />

susta<strong>in</strong>ability, protect<strong>in</strong>g heritage and environmental assets and<br />

amenity, and <strong>in</strong>volv<strong>in</strong>g the community <strong>in</strong> <strong>plann<strong>in</strong>g</strong> decisions.<br />

In undertak<strong>in</strong>g its <strong>plann<strong>in</strong>g</strong> function, the council is obliged<br />

under the Plann<strong>in</strong>g and Environment Act 1987 to give<br />

consideration to the relevant legislative and <strong>plann<strong>in</strong>g</strong> scheme<br />

requirements (<strong>in</strong>clud<strong>in</strong>g the overall objectives of the scheme)<br />

before mak<strong>in</strong>g decisions on applications for <strong>plann<strong>in</strong>g</strong> permits.<br />

13. The council should also:<br />

develop a more constructive and cooperative relationship<br />

with other government agencies and bodies which have an<br />

<strong>in</strong>terest <strong>in</strong> <strong>plann<strong>in</strong>g</strong> decisions (such as the Department of<br />

Susta<strong>in</strong>ability and Environment and Heritage Victoria)<br />

attempt to resolve contentious issues through a consultation<br />

process with objectors, rather than issu<strong>in</strong>g permits and<br />

deal<strong>in</strong>g with objections at VCAT<br />

adequately support its decisions with a <strong>plann<strong>in</strong>g</strong> report that<br />

fully addresses the requirements of the <strong>plann<strong>in</strong>g</strong> scheme<br />

and relevant legislation.<br />

<strong>Council</strong> gives a commitment to consider an appropriate balance between its<br />

objective of promot<strong>in</strong>g economic development and its other objectives of<br />

susta<strong>in</strong>ability, protect<strong>in</strong>g heritage and environmental assets and amenity, and<br />

<strong>in</strong>volv<strong>in</strong>g the community <strong>in</strong> <strong>plann<strong>in</strong>g</strong> decisions. Due consideration will be<br />

given to the relevant legislative and <strong>plann<strong>in</strong>g</strong> scheme requirements.<br />

In-house <strong>plann<strong>in</strong>g</strong> staff are establish<strong>in</strong>g work<strong>in</strong>g relationships with a range of<br />

government agencies and bodies.
