There were also numerous problems with the proposal, <strong>in</strong>clud<strong>in</strong>g:<br />
an <strong>in</strong>crease <strong>in</strong> the number of lots, which is not allowable under the scheme<br />
re-subdivision of land across different zones, which is not allowable under the<br />
scheme<br />
the development of hous<strong>in</strong>g along the coast, which is <strong>in</strong>consistent with the<br />
objectives of the Victorian Coastal Strategy<br />
unplanned residential development <strong>in</strong> the Bridgewater Bay coastal area, which<br />
is contrary to the objectives of the scheme<br />
removal of coastal vegetation to the detriment of the environmental and<br />
landscape quality of the Bridgewater Bay coastl<strong>in</strong>e.<br />
In August 2004, the council made an application to VCAT to cancel the permit. In<br />
December, with the agreement of the applicant, VCAT ordered the permit to be<br />
cancelled on the basis that a material mistake had been made <strong>in</strong> grant<strong>in</strong>g the<br />
permit.<br />

Conclusion<br />
The pr<strong>in</strong>cipal purpose of the Rural Zone is to support agriculture and<br />
promote effective land management practices. The purpose of the<br />
Environmental Rural Zone is to protect high environmental value or high<br />
agricultural value land. However, the council’s application of the<br />
subdivision zone controls and other requirements of the scheme, does not<br />
achieve these purposes.<br />
The way <strong>in</strong> which the council has applied the <strong>plann<strong>in</strong>g</strong> scheme has led to<br />
the subdivision of rural land to its lowest common denom<strong>in</strong>ator rather<br />
than subdivision based on agricultural or environmental outcomes. This<br />
approach is contrary to one of the ma<strong>in</strong> objectives of the Act, which is to<br />
make <strong>plann<strong>in</strong>g</strong> decisions on the basis of land capability and suitability and<br />
hav<strong>in</strong>g regard to environmental outcomes.<br />
These <strong>plann<strong>in</strong>g</strong> decisions may have adversely impacted on the<br />
susta<strong>in</strong>ability of rural enterprises and led to the loss and under-utilisation<br />
of agricultural land <strong>in</strong> the shire.
