<strong>Council</strong>’s current processes ensure that amendments are <strong>in</strong> accordance with<br />

the provisions of the Act.<br />

3.6 Decision-mak<strong>in</strong>g<br />

As we have reported, <strong>in</strong> mak<strong>in</strong>g a decision about whether or not to grant a<br />

<strong>plann<strong>in</strong>g</strong> permit, numerous factors need to be considered. These <strong>in</strong>clude<br />

compliance with the Act and <strong>plann<strong>in</strong>g</strong> scheme, objections from the public,<br />

and comments from referral authorities and other relevant organisations. A<br />

permit that complies with the Act and <strong>plann<strong>in</strong>g</strong> scheme can be granted<br />

where there are no objections.<br />

Where there are objections, these need to be considered and a decision<br />

made on whether the concerns are significant enough to result <strong>in</strong> the<br />

rejection of the application for a permit.<br />

Once the decision is made, the council is required to issue a Notice of<br />

Decision outl<strong>in</strong><strong>in</strong>g its decision and reasons to objectors and the applicant. If<br />

no appeals are lodged with<strong>in</strong> 21 days follow<strong>in</strong>g the decision, a permit can<br />

be issued.<br />

It is considered sound practice to support each <strong>plann<strong>in</strong>g</strong> decision with a<br />

<strong>plann<strong>in</strong>g</strong> report. This report would normally conta<strong>in</strong>:<br />

a description of the site and surrounds<br />

a description of the proposal<br />

details of the relevant policy, strategy and provisions of the <strong>plann<strong>in</strong>g</strong><br />

scheme<br />

a summary of any objections<br />

a <strong>plann<strong>in</strong>g</strong> assessment that:<br />

<strong>in</strong>dicates how the proposal advances the council’s <strong>plann<strong>in</strong>g</strong> strategy<br />

and objectives of the <strong>plann<strong>in</strong>g</strong> scheme<br />

<strong>in</strong>cludes discussion on potential impacts of the proposal on adjo<strong>in</strong><strong>in</strong>g<br />

properties and the environment<br />

a recommendation to council.
