from the M<strong>in</strong>ister for Plann<strong>in</strong>g to prepare necessary<br />
amendments to the <strong>plann<strong>in</strong>g</strong> scheme).<br />

The <strong>Glenelg</strong> <strong>Shire</strong> <strong>Council</strong> town <strong>plann<strong>in</strong>g</strong> department is now proactive <strong>in</strong><br />
tak<strong>in</strong>g environmental values <strong>in</strong>to consideration when assess<strong>in</strong>g applications.<br />
<strong>Council</strong>’s <strong>plann<strong>in</strong>g</strong> scheme was an early scheme. <strong>Council</strong> is now aware the<br />
scheme was poorly drafted leav<strong>in</strong>g significant scope for mis<strong>in</strong>terpretation. The<br />
need to <strong>in</strong>corporate development plans and difficulty clarify<strong>in</strong>g boundaries to<br />
an environmental rural zone (ERZ) are examples. <strong>Council</strong> has sought<br />
resolution to these issues. The <strong>plann<strong>in</strong>g</strong> scheme has been amended <strong>in</strong> relation<br />
to development plans. <strong>Council</strong> is seek<strong>in</strong>g declaration <strong>in</strong> VCAT <strong>in</strong> relation to<br />
the ERZ boundaries.<br />
3.5.5 Subdivision of land<br />
The subdivision of land is controlled through the <strong>plann<strong>in</strong>g</strong> system. In most<br />
cases, a <strong>plann<strong>in</strong>g</strong> permit is required before land can be subdivided.<br />
The Subdivision Act 1988 sets out the procedures to be followed by councils<br />
<strong>in</strong> certify<strong>in</strong>g plans and issu<strong>in</strong>g statements of compliance. The approval<br />
process for a land subdivision is the same as for any other type of <strong>plann<strong>in</strong>g</strong><br />
application. Applications and plans for subdivisions must also be referred<br />
to the relevant water, sewerage, dra<strong>in</strong>age, gas and telecommunications<br />
agencies.<br />
It is essential that the council and referral authorities give proper<br />
consideration to subdivision at the <strong>plann<strong>in</strong>g</strong> stage, as it is not possible to<br />
place additional requirements on a subdivision once a <strong>plann<strong>in</strong>g</strong> permit has<br />
been issued. Conditions on permits should, therefore, cover the full range<br />
of matters that the referral authorities require to be addressed.
