112 Did the council effectively manage its outsourced <strong>plann<strong>in</strong>g</strong> <strong>services</strong>?<br />

Liaise with developers, ratepayers and government departments. While the<br />

<strong>plann<strong>in</strong>g</strong> contractor liaised with developers <strong>in</strong> assess<strong>in</strong>g applications, at<br />

times applications <strong>in</strong>volv<strong>in</strong>g key <strong>plann<strong>in</strong>g</strong> matters were not referred to<br />

government agencies such as the Department of Susta<strong>in</strong>ability and<br />

Environment and Heritage Victoria, as required by the Plann<strong>in</strong>g and<br />

Environment Act 1987.<br />

Liaise with the council’s heritage adviser. Liaison about whether a <strong>plann<strong>in</strong>g</strong><br />

proposal did or did not have heritage implications rarely occurred<br />

between the <strong>plann<strong>in</strong>g</strong> contractor and the adviser.<br />

Attend council meet<strong>in</strong>gs. Despite be<strong>in</strong>g required to attend 90 per cent of<br />

meet<strong>in</strong>gs, the <strong>plann<strong>in</strong>g</strong> contractor attended only 9 meet<strong>in</strong>gs (from a total<br />

of 85 meet<strong>in</strong>gs) over a 5-year period from 2000 to 2004. Plann<strong>in</strong>g reports<br />

prepared by the <strong>plann<strong>in</strong>g</strong> contractor were, however, submitted to<br />

council <strong>in</strong> 39 of the meet<strong>in</strong>gs. We were advised by council staff that<br />

some councillors had direct discussions with the <strong>plann<strong>in</strong>g</strong> contractor<br />

about specific <strong>plann<strong>in</strong>g</strong> issues. This practice may have resulted <strong>in</strong> some<br />

significant <strong>plann<strong>in</strong>g</strong> issues by-pass<strong>in</strong>g council’s senior management and<br />

the full scrut<strong>in</strong>y of the council.<br />

Develop town <strong>plann<strong>in</strong>g</strong> policies, guidel<strong>in</strong>es and strategies. The <strong>plann<strong>in</strong>g</strong><br />

contractor’s work <strong>in</strong> this area was limited. He produced an <strong>in</strong>formation<br />

brochure of the service the community could expect to receive from the<br />

council on <strong>plann<strong>in</strong>g</strong> matters. Information was also provided on the<br />

council’s website. <strong>Council</strong> staff have only recently developed procedural<br />

<strong>in</strong>formation to support the town <strong>plann<strong>in</strong>g</strong> function (August 2004).<br />

Initiate at least one sem<strong>in</strong>ar or workshop per year on town <strong>plann<strong>in</strong>g</strong> or urban<br />

design. This was not done.<br />

Prepare a cont<strong>in</strong>uous improvement program and a works schedule with<br />

performance targets. The <strong>plann<strong>in</strong>g</strong> contractor prepared a performance<br />

program, schedule and performance <strong>in</strong>dicators. There is no evidence<br />

that the contract manager assessed the appropriateness or quality of the<br />

<strong>in</strong>formation prepared, or that the actions proposed <strong>in</strong> the program were<br />

undertaken by the <strong>plann<strong>in</strong>g</strong> contractor.<br />

Provide fortnightly time sheets. The <strong>plann<strong>in</strong>g</strong> contractor did submit<br />

fortnightly time sheets to the council (as a council employee), but the<br />

time sheets did not record the specific activities performed by him and<br />

decisions he made, while <strong>in</strong> the role of council employee. This was<br />

required under his employment contract.<br />

The contract for <strong>plann<strong>in</strong>g</strong> <strong>services</strong> provides for the council to take action<br />

aga<strong>in</strong>st the contractor for non-performance. Our review disclosed that<br />

despite the contractor’s failure to meet some of the service standards<br />

outl<strong>in</strong>ed <strong>in</strong> his contract, the council had not specifically raised issues of<br />

non-performance with him until around July 2004.
