Recommendation agreed.<br />
The review of the Municipal Strategic Strategy (MSS) has been completed. The<br />
report was adopted by council <strong>in</strong> February <strong>2005</strong>. The Master <strong>Community</strong><br />
Settlement Plan is to be undertaken as a priority. The MSS will then be<br />
redrafted.<br />
Draft<strong>in</strong>g of statutory policies for <strong>in</strong>corporation <strong>in</strong>to the local <strong>plann<strong>in</strong>g</strong> policy<br />
framework has been actioned.<br />
<strong>Council</strong> now has an <strong>in</strong>-house strategic <strong>plann<strong>in</strong>g</strong> unit to undertake regular<br />
reviews of its <strong>plann<strong>in</strong>g</strong> scheme.<br />
4.4 Arrangements for the delivery of <strong>plann<strong>in</strong>g</strong><br />
<strong>services</strong><br />
The <strong>plann<strong>in</strong>g</strong> contractor provided <strong>plann<strong>in</strong>g</strong> <strong>services</strong> to the council from<br />
March <strong>1998</strong> to March <strong>2005</strong> 37 . The value of the <strong>plann<strong>in</strong>g</strong> contractor’s most<br />
recent contract (5-year contract commenc<strong>in</strong>g January 2003), prior to its<br />
term<strong>in</strong>ation at the end of 2004, was $1.02 million, plus CPI adjustments.<br />
At the same time, the <strong>plann<strong>in</strong>g</strong> contractor was also employed by the council<br />
as a staff member for 5 hours per week. In this role (as council town planner),<br />
he had delegated authority to approve <strong>plann<strong>in</strong>g</strong> permits on behalf of the<br />
council.<br />
The Victorian Government Solicitor advised us that under the Act, this<br />
arrangement was not unlawful. He did consider it, however, to be<br />
unsatisfactory “because of a high potential to blur the two roles” 38 .<br />
For example, on any given day, the <strong>plann<strong>in</strong>g</strong> contractor was likely to<br />
undertake tasks related to both his role as provider of contracted <strong>plann<strong>in</strong>g</strong><br />
<strong>services</strong> and council town planner. These could <strong>in</strong>clude:<br />
receiv<strong>in</strong>g, record<strong>in</strong>g and ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g <strong>plann<strong>in</strong>g</strong> applications<br />
decid<strong>in</strong>g whether a person or persons might be affected by the grant of a<br />
<strong>plann<strong>in</strong>g</strong> permit<br />
assess<strong>in</strong>g public submissions on proposed amendments to the <strong>plann<strong>in</strong>g</strong><br />
scheme<br />
