74 Did the council comply with key legislative, <strong>plann<strong>in</strong>g</strong> scheme and other requirements?<br />

<strong>Council</strong>lors were not actively <strong>in</strong>volved. The <strong>plann<strong>in</strong>g</strong> contractor submitted<br />

detailed reports to the council meet<strong>in</strong>gs about some applications for<br />

<strong>plann<strong>in</strong>g</strong> permits. However, most of the applications that have been the<br />

subject of VCAT appeals were not discussed by councillors before a<br />

decision was made to grant the permit.<br />

Most VCAT decisions on council <strong>plann<strong>in</strong>g</strong> matters over the past 5 years were<br />

made aga<strong>in</strong>st council. Although the number of council <strong>plann<strong>in</strong>g</strong> matters<br />

brought before VCAT was not significant when compared with the total<br />

number of applications received (an overall average of 1.3 per cent), 62<br />

per cent of the decisions made by VCAT were aga<strong>in</strong>st the council32 . At<br />

August <strong>2005</strong>, 9 <strong>plann<strong>in</strong>g</strong> matters were before VCAT.<br />

Dissatisfaction with <strong>plann<strong>in</strong>g</strong> decisions. There was a considerable level of<br />

dissatisfaction with many of the council’s <strong>plann<strong>in</strong>g</strong> decisions by the<br />

Department of Susta<strong>in</strong>ability and Environment, Heritage Victoria and<br />

the local heritage committee.<br />

Conclusion<br />

The lack of support<strong>in</strong>g documentation, extraord<strong>in</strong>arily quick process<strong>in</strong>g<br />

time and low refusal rate for <strong>plann<strong>in</strong>g</strong> permit applications <strong>in</strong>dicate that<br />

these applications are more than likely not to have been adequately<br />

assessed.<br />

Furthermore, our <strong>in</strong>vestigation of specific <strong>plann<strong>in</strong>g</strong> decisions, VCAT<br />

rul<strong>in</strong>gs and the dissatisfaction of other government agencies with many of<br />

the council’s <strong>plann<strong>in</strong>g</strong> decisions, <strong>in</strong>dicate that a number of the <strong>plann<strong>in</strong>g</strong><br />

applications approved by the council were <strong>in</strong>appropriate.<br />

Had councillors had a greater <strong>in</strong>volvement <strong>in</strong> oversee<strong>in</strong>g the council’s<br />

<strong>plann<strong>in</strong>g</strong> function many of these problems may have been overcome. See<br />

comments <strong>in</strong> section 5.3.3 of this report.<br />
