2.1 Victoria’s <strong>plann<strong>in</strong>g</strong> system<br />
Victoria’s <strong>plann<strong>in</strong>g</strong> system 13<br />
Plann<strong>in</strong>g is essentially about the use, development and protection of land<br />
<strong>in</strong> the present and long-term <strong>in</strong>terests of the community. Plann<strong>in</strong>g <strong>in</strong><br />
Victoria is pr<strong>in</strong>cipally implemented through the Plann<strong>in</strong>g and Environment<br />
Act 1987. The state’s <strong>plann<strong>in</strong>g</strong> objectives are to ensure the strategic and<br />
orderly use and development of land with regard to environmental, social,<br />
heritage and community <strong>in</strong>terests.<br />
Key organisations with<strong>in</strong> Victoria’s <strong>plann<strong>in</strong>g</strong> system are:<br />
Plann<strong>in</strong>g and responsible authorities<br />
Plann<strong>in</strong>g authorities develop and amend <strong>plann<strong>in</strong>g</strong> schemes to give<br />
direction on how broader state <strong>plann<strong>in</strong>g</strong> policies will be achieved or<br />
implemented <strong>in</strong> the local context. Responsible authorities manage the<br />
day-to-day adm<strong>in</strong>istration of the local <strong>plann<strong>in</strong>g</strong> scheme. They process<br />
applications for <strong>plann<strong>in</strong>g</strong> permits and enforce the scheme and<br />
conditions <strong>in</strong>corporated <strong>in</strong> <strong>plann<strong>in</strong>g</strong> permits. Usually, the <strong>plann<strong>in</strong>g</strong><br />
and/or responsible authority is the local council.<br />
M<strong>in</strong>ister for Plann<strong>in</strong>g<br />
The m<strong>in</strong>ister has overall responsibility for the state’s <strong>plann<strong>in</strong>g</strong> legislation<br />
and framework. In addition, the m<strong>in</strong>ister has wide-rang<strong>in</strong>g powers to<br />
grant exemptions from comply<strong>in</strong>g with legislative requirements, make<br />
directions to <strong>plann<strong>in</strong>g</strong> authorities and responsible authorities, approve<br />
<strong>plann<strong>in</strong>g</strong> scheme amendments, and review cases where there is an issue<br />
of state policy or a need to <strong>in</strong>tervene <strong>in</strong> order to expedite the process.<br />
Department of Susta<strong>in</strong>ability and Environment<br />
At the policy level, the department adm<strong>in</strong>isters the <strong>plann<strong>in</strong>g</strong> framework.<br />
It also supports the m<strong>in</strong>ister to fulfil his responsibilities under the Act.<br />
Panels and advisory committees<br />
The Act requires the m<strong>in</strong>ister to appo<strong>in</strong>t a panel to consider submissions<br />
required to be referred to it under the Plann<strong>in</strong>g and Environment Act<br />
1987. The m<strong>in</strong>ister may also set up advisory committees to provide<br />
advice on particular <strong>plann<strong>in</strong>g</strong> issues as required.<br />
Victorian Civil and Adm<strong>in</strong>istrative Tribunal<br />
Parties aggrieved by the <strong>plann<strong>in</strong>g</strong> decisions of responsible authorities<br />
may appeal to the tribunal for a review of the decision.
