F<strong>in</strong>d<strong>in</strong>gs of our review<br />

The State Plann<strong>in</strong>g Policy Framework requires the council to identify,<br />

conserve and protect places of natural or cultural value from <strong>in</strong>appropriate<br />

development. We found that the council failed to protect, through<br />

appropriate <strong>plann<strong>in</strong>g</strong> controls, an area of historical and Aborig<strong>in</strong>al<br />

significance known as the Conv<strong>in</strong>c<strong>in</strong>g Ground.<br />

The Conv<strong>in</strong>c<strong>in</strong>g Ground is significant as the site of an historic whal<strong>in</strong>g<br />

station and the scene of a conflict <strong>in</strong> the 1830s that resulted <strong>in</strong> the massacre<br />

of Aborig<strong>in</strong>al people by the first European settlers <strong>in</strong> Victoria. The site is<br />

registered with AAV as an Aborig<strong>in</strong>al Heritage Place.<br />

The area is also considered to be of great cultural and historical<br />

significance by members of the Gunditjmara Aborig<strong>in</strong>al community, many<br />

of whom live <strong>in</strong> Portland and surround<strong>in</strong>g areas.<br />

Case study 4 shows how works have commenced that are potentially<br />

<strong>in</strong>consistent with the <strong>plann<strong>in</strong>g</strong> scheme, and <strong>in</strong> breach of state and<br />

Commonwealth legislation that aims to protect areas of significance.<br />

Case study 5 shows how the council, <strong>in</strong> assess<strong>in</strong>g an application,<br />

potentially failed to follow due process.<br />

The applications discussed <strong>in</strong> these case studies are the subject of current<br />

applications to VCAT.<br />

A further issue associated with these <strong>plann<strong>in</strong>g</strong> applications is <strong>in</strong> relation to<br />

the absence of an appropriately constituted development plan for the site.<br />

Further comment is provided <strong>in</strong> section 3.5.6.<br />

THE CONVINCING GROUND: BACKGROUND TO THE CASE STUDIES<br />

In 2000, the council proposed re-open<strong>in</strong>g the Old Coach Road, located on<br />

the north shore of Portland Bay, as part of a development proposal. This<br />

road passes through the Conv<strong>in</strong>c<strong>in</strong>g Ground. Prior to open<strong>in</strong>g the road,<br />

the council engaged consultants to conduct an archaeological survey and<br />

prepare a report.
