66 Did the council comply with key legislative, <strong>plann<strong>in</strong>g</strong> scheme and other requirements?<br />

At this same meet<strong>in</strong>g, the <strong>plann<strong>in</strong>g</strong> contractor canvassed a proposal<br />

whereby plans submitted with permit applications could be used as a<br />

substitute for a development plan. This would avoid some of the costs<br />

associated with the council establish<strong>in</strong>g a development plan.<br />

Annual budget submissions for the <strong>plann<strong>in</strong>g</strong> function, prepared by the<br />

<strong>plann<strong>in</strong>g</strong> contractor, requested additional fund<strong>in</strong>g for the preparation of<br />

development plans.<br />

A number of meet<strong>in</strong>gs between the Department of Infrastructure (when<br />

that department had responsibility for the <strong>plann<strong>in</strong>g</strong> function) and the<br />

council considered this issue and recommended amend<strong>in</strong>g the <strong>plann<strong>in</strong>g</strong><br />

scheme to abolish the DPOs.<br />

The need to correct the “<strong>in</strong>adequacies <strong>in</strong> the <strong>plann<strong>in</strong>g</strong> scheme” with<br />

regards to development plans was raised <strong>in</strong> VCAT <strong>plann<strong>in</strong>g</strong> application<br />

hear<strong>in</strong>gs, as far back as 2001.<br />

In February 2002, the council exhibited an amendment to its <strong>plann<strong>in</strong>g</strong><br />

scheme 27 that <strong>in</strong>cluded the removal of all development plan overlays. The<br />

documentation support<strong>in</strong>g the amendment contended that the DPOs are<br />

“… an unnecessary duplication of controls conta<strong>in</strong>ed elsewhere <strong>in</strong> the<br />

<strong>plann<strong>in</strong>g</strong> scheme”.<br />

As there were objections to the amendment, the council decided to split the<br />

amendment <strong>in</strong>to parts – adopt one part (without submissions) and refer<br />

the submissions related to part 2 to an <strong>in</strong>dependent panel (appo<strong>in</strong>ted by<br />

the m<strong>in</strong>ister) for review. This is <strong>in</strong> accordance with the Act.<br />

We were advised that this review process was not undertaken.<br />

As the council had not established development plans for its DPOs, the<br />

council’s <strong>plann<strong>in</strong>g</strong> contractor was faced with the prospect of reject<strong>in</strong>g all<br />

<strong>plann<strong>in</strong>g</strong> permit applications <strong>in</strong> areas covered by the DPOs. This would<br />

have had a significant adverse impact on the shire’s development activity.<br />

In these circumstances, the <strong>plann<strong>in</strong>g</strong> contractor, act<strong>in</strong>g as the council’s<br />

delegate, decided to use the project/site plans provided with <strong>plann<strong>in</strong>g</strong><br />

applications as a substitute for a development plan. The <strong>plann<strong>in</strong>g</strong><br />

contractor considered that this enabled him to cont<strong>in</strong>ue process<strong>in</strong>g and<br />

issu<strong>in</strong>g <strong>plann<strong>in</strong>g</strong> permits <strong>in</strong> areas covered by DPOs.<br />

27 Amendment C5 relates to errors and <strong>in</strong>consistencies <strong>in</strong> the scheme, m<strong>in</strong>or re-zon<strong>in</strong>g and<br />

implementation of <strong>plann<strong>in</strong>g</strong>-related matters. We discuss this further <strong>in</strong> Part 4 of this report.
