Did the council have appropriate management arrangements for the delivery of its <strong>plann<strong>in</strong>g</strong> <strong>services</strong>? 97<br />

The new <strong>in</strong>strument extended significant <strong>plann<strong>in</strong>g</strong> delegations to the<br />

council’s CEO and provided for appropriate delegations to the new statutory<br />

planner. It amended and revoked a number of the <strong>plann<strong>in</strong>g</strong> contractor’s<br />

authorities.<br />

4.9.2 Plann<strong>in</strong>g procedures<br />

To support the revised <strong>plann<strong>in</strong>g</strong> model, a comprehensive procedures manual<br />

was developed <strong>in</strong> July 2004 for use by the council’s <strong>plann<strong>in</strong>g</strong> <strong>services</strong> unit. It<br />

<strong>in</strong>cludes proformas, templates, check lists, performance/service targets and<br />

protocols.<br />

Importantly, the new procedures address the concerns of key stakeholders,<br />

and <strong>in</strong>clude:<br />

strict application of “material detriment” and notification of applications to<br />

<strong>in</strong>terested parties<br />

a direction that no <strong>plann<strong>in</strong>g</strong> application be processed and approved <strong>in</strong> less<br />

than 5 work<strong>in</strong>g days (considered the m<strong>in</strong>imum time <strong>in</strong> which a <strong>plann<strong>in</strong>g</strong><br />

application can be adequately assessed)<br />

a “call-<strong>in</strong>” protocol where councillors may at any time prior to a decision<br />

be<strong>in</strong>g made on the application, ask that the matter be referred to the<br />

council for determ<strong>in</strong>ation. This may occur where the council considers the<br />

application raises issues of genu<strong>in</strong>e municipality-wide significance. This<br />

may be <strong>in</strong> relation to achiev<strong>in</strong>g or <strong>in</strong>terpret<strong>in</strong>g local <strong>plann<strong>in</strong>g</strong> policy or<br />

because the application may have material impact across municipal<br />

boundaries<br />

improved documentation and file record<strong>in</strong>g processes to support decisions<br />

made.<br />

4.9.3 Delegated Plann<strong>in</strong>g Committee<br />

The Delegated Plann<strong>in</strong>g Committee (DPC) comprises 5 councillors and<br />

<strong>plann<strong>in</strong>g</strong> personnel. The DPC operates under a separate <strong>in</strong>strument of<br />

delegation from council that provides for:<br />

permit applications to be referred to the DPC for mediation and/or<br />

determ<strong>in</strong>ation where an objection has been received that has not been<br />

resolved through consultation with the relevant parties. Where 2 or more<br />

objections have been received, applications must be referred to the DPC for<br />

mediation and/or determ<strong>in</strong>ation
