CASE STUDY 11: PERMIT AMENDED WITHOUT SUPPORTING DOCUMENTATION<br />

<strong>Council</strong> received an application <strong>in</strong> March 2003 for a permit to undertake a 6-lot<br />

subdivision. Although no assessment report was on file, nor any record of a site<br />

<strong>in</strong>spection, the council considered that the subdivision could cause detriment to<br />

owners and occupiers of adjo<strong>in</strong><strong>in</strong>g properties, and advertised the application <strong>in</strong><br />

the local newspaper.<br />

The council received no objections to the proposal and a permit was issued <strong>in</strong><br />

mid-November 2003 with 13 conditions (cover<strong>in</strong>g dra<strong>in</strong>age and specific<br />

requirements of referral authorities). However, the plan attached to the approved<br />

permit was for a 7-lot subdivision (and not 6 as <strong>in</strong>itially applied for).<br />

Late <strong>in</strong> November 2003 and early December 2003, the applicant asked for an<br />

amended plan for the land which provided for the 7-lot subdivision, staged<br />

development of the land and a change <strong>in</strong> the layout.<br />

The permit was amended on 9 December 2003 <strong>in</strong> accordance with the applicant’s<br />

request. The file conta<strong>in</strong>ed no <strong>in</strong>formation justify<strong>in</strong>g the decision to amend the<br />

permit. Nor did it <strong>in</strong>clude evidence that the impact of the changes on adjo<strong>in</strong><strong>in</strong>g<br />

property holders or others had been considered.<br />

Conclusion<br />

The notification and other requirements of the <strong>plann<strong>in</strong>g</strong> scheme and the<br />

Act are designed to ensure:<br />

community <strong>in</strong>volvement <strong>in</strong> <strong>plann<strong>in</strong>g</strong> decisions likely to impact on them<br />

that land use or developments proposed <strong>in</strong> the permit applications<br />

comply with the requirements of the scheme.<br />

Where substantive changes are made to permits that bypass the normal<br />

<strong>plann<strong>in</strong>g</strong> process, the <strong>in</strong>tegrity of the <strong>plann<strong>in</strong>g</strong> process is called <strong>in</strong>to<br />

question.<br />

Amendments to <strong>plann<strong>in</strong>g</strong> permits exam<strong>in</strong>ed by us <strong>in</strong>dicated that, <strong>in</strong> some<br />

cases, such changes were made.<br />

Recommendation<br />

11. That the council comply with legislative requirements <strong>in</strong><br />

process<strong>in</strong>g applications for amendments to permits.
